COMPOSITE OFF-STREET PARKING ORDER 2013 NUMBER 1
(AMENDMENT) ORDER 2023
NOTICE IS GIVEN that The Borough Council of Pendle has on 3 March 2023 made the above Order under sections 32, 33 and 35 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (as amended) and all other enabling legislation. The effect of the Order is to amend the Composite Off-Street Parking Order 2013 Number 1 as follows:
1. The deletion from Schedule 2 (Long Stay) of the Colne Lane Colne Parking Place
2. The deletion from Schedule 3 (Short Stay) of the Palace Car Park Nelson
3. The addition to Schedule 2 (Long Stay) of the Palace Car Park Nelson
4. The addition to Schedule 3 (Short Stay) of the Colne Lane Car Park Colne
5. The addition to Schedule 3 (Short Stay) of the Parliament Street Car Park Colne
6. Amend the wording in Clause 15 Parking Contravention to read: Any contravention of or non-compliance with a provision of this Order is a parking contravention in relation to the Vehicle concerned for the purposes of The Civil Enforcement of Road Traffic Contraventions (Approved Devices, Charging Guidelines and General Provisions) (England) Regulations 2022
A copy of the Order may be inspected at Number One Market Street in Nelson, Monday to Friday between 9am and 4pm or by request via telephone 01282 661642 or legal@pendle.gov.uk. Anyone wishing to question the validity of the Order or of any provision contained in it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984 as amended, or on the grounds that any requirement of the Act or any instrument made under it has not been complied in relation to the Order, may within six weeks from the date of this notice apply to the High Court for this purpose
