What is happening?

The County Council Of Durham (Brasside, Durham) (Prohibition of Waiting) Order 2026

On 2/10/2026 the County Council made an Order under Sections 9 and 10, of the Road Traffic Regulation Act 1984 (“RTRA”), as amended, the effect of which comes into operation on 15/10/2026 and will make permanent the experimental order that has been in operation since 23/1/2025. The Order will make permanent the following restrictions:

Prohibition of Waiting Restrictions on the following lengths of road at Brasside, Durham.

Finchale Avenue (Unc 19312)

1. from a point 6.2 metres east of Number 28 ‘Finchale Avenues’ western property boundary on the southern side of the road in a westerly direction for a distance of 115.7 metres around the junction into ‘Finchale Avenue’

2. from a point north of Number 31 ‘Finchale Avenues’ north-eastern property boundary in a westerly direction for a distance of 27.2 metres on the southern side of the road until the rear of the bus stop clearway

3. from a point immediately west of the bus stop clearway on the southern side of the road running in a westerly direction for a distance of 97.2 metres

4. from a point immediately east of the bus stop clearway on the northern side of the road in a easterly direction and around its junction with ‘Rowan Drive’ for a distance of 10.4 metres.

Rowan Drive

5. from a point 8.4 metres south of Numbers 16 ‘Rowan Drives’ northern property boundary in a southerly direction for a distance of 31.6 metres onto ‘Finchale Avenue’.

Unc 19.12 (access road to Priory Gill and Priory Cottage)

6. on the western side of the road from a point 73.8 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres.

7. on the western side of the road from a point 118.8 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres.

8. on the western side of the road from a point 163.8 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres

9. on the eastern side of the road from a point 194.5 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 14.3 metres

10. on both sides of the road from a point 208.8 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres

11. on the eastern side of the road from a point 231.3 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres

12. on both sides of the road from a point 253.8 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres

13. on the eastern side of the road from a point 276.3 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres

14. on both sides of the road from a point 298.8 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres

15. on the eastern side of the road from a point 321.3 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 22.5 metres

16. on both sides of the road from a point 343.8 metres north of its junction with ‘Finchale Avenue’ in a northerly direction for a distance of 171.3 metres.

A copy of the Order may be inspected at Consett Library during normal opening hours and via the Councils website. Any person wishing to question the validity of the Order or of any provision contained in it on the grounds that it is not within the powers conferred by the “RTRA”, as amended, or on the grounds that any requirement of that Act or of any regulation made under it has not been complied with in relation to the Order may, within six weeks from 2/10/2026 apply to make an application for that purpose to the High Court.
