What is happening?
NOTICE OF CONFIRMATION OF ORDERS HIGHWAYS ACT 1980 WILDLIFE AND COUNTRYSIDE ACT 1981
DEVON COUNTY COUNCIL (FOOTPATH NO. 19, (PART) TIVERTON) (FOOTPATH NO 1, LOXBEARE & FOOTPATH NO 11, WASHFIELD)
PUBLIC PATH EXTINGUISHMENT AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDERS 2025
On 20th August 2026 Devon County Council confirmed the above Orders made under Section 118 of the Highways Act 1980 and Section 53A(2) of the Wildlife and Countryside Act 1981 as unopposed Orders. The effect of the Orders is to extinguish:
1. Part of Footpath No. 19, Tiverton running from the north bank of the River Lowman, south east of Little Gornhay, south south westwards to the northern boundary of the A361 dual carriageway and
2. Footpath No 1, Loxbeare & Footpath No. 11, Washfield running from the county road east of Loxbeare church generally northwards to Long Lane in Washfield parish, both as shown on the Order maps and in the district of Mid Devon.
A copy of the confirmed Orders and the Order maps can be seen free of charge at Tiverton Library, Tiverton and Tiverton Town Council Offices (Footpath No 19, Tiverton) during opening hours; on request to the Washfield Parish Clerk (Footpath No.1 Loxbeare & Footpath No. 11 Washfield), at Devon County Council, Great Moor House, Sowton, Exeter by appointment (Tel 01392 382833) and at www.devon.gov.uk/haveyoursay under Public Rights of Way - Tiverton, Loxbeare or Washfield.
The Orders come into force on 13th October 2026, but if a person aggrieved by an Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from the date of this notice, make an application to the High Court.
