Notice of Confirmation of a Public Path Order

The Cornwall Council (Footpath No.12 (Part) in the Parish of Kea) Public Path Diversion Order 2018

On 17 December 2020, the above order was confirmed by the Secretary of State which was made under section 119 of the Highways Act 1980.

The effect of the order as confirmed is to divert a length of Public Footpath No.12 in the Parish of Kea commencing at the western end of Public Footpath No.12 Kea to be retained 50 metres south-east of the property ‘Treloggas Barn’ at Ordnance Survey Grid Reference (OSGR) SW 8247/4100 then continuing in a north-westerly then westerly then west-south-westerly then westerly direction for 167 metres and terminating at a length of Public Footpath No.12 Kea to be retained 110 metres west-south-west of the property ‘Treloggas Barn’ at OSGR SW 8232/4099 to a revised length of Public Footpath in the Parish of Kea commencing at the eastern end of Public Footpath No. 12 Kea to be retained 110 metres west-south-west of the property ‘Treloggas Barn’ at OSGR SW8232/4099 then continuing in a south-easterly and then east-north-easterly direction for 47 metres at OSGR SW8236/4099 then continuing in a north-easterly direction for 23 metres to OSGR 8238/4100 then continuing in a generally south-easterly direction for 95 metres to OSGR 8247/4096 where it has a junction with Unclassified County Road U6069 70 metres south of the property ‘Treloggas Barn’.

A copy of the operative order and order map may be downloaded from Cornwall Council’s website at https://www.cornwall.gov.uk/environment/countryside/public-path-orders/confirmed-public-path-orders/ and have also been placed and may be seen free of charge at Truro Library open on Monday to Friday 9am to 5pm and Saturday at 10am to 4pm. Alternatively copies of the order and order map may be obtained free of charge from proworders@cornwall.gov.uk.

The order came into force on the date on which the order was confirmed, but if any person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from the date of this Notice, make application to the High Court.
