WILDLIFE & COUNTRYSIDE ACT 1981 - SECTION 53
THE DEFINITIVE MAP & STATEMENT FOR THE FORMER PENWITH DISTRICT AREA

THE CORNWALL COUNCIL (ADDITION OF RESTRICTED BYWAYS AT ESCALLS COMMON IN THE PARISHES OF ST BURYAN, LAMORNA & PAUL AND SENN EN) MODIFICATION ORDER 2026

The above Order made on 24 September 2026, if confirmed as made, will modify the definitive map & statement for the area by:

i) Adding a length of Restricted Byway in moiety in the Parishes of St Buryan, Lamorna & Paul and Sennen from Classified Road A30, 229 metres west-southwest of 'Keigwin' at Ordnance Survey Grid Reference (OSGR) SW 3767 /2729, then running in a south-south-easterly direction for 23 metres to its junction with another Restricted Byway to be added by this Order at OSGR SW 3768/2726, then running in a south-south-easterly then east-south-easterly direction for 309 metres terminating at its junction with the Parish Boundary and Footpath 38 St Buryan, Lamorna & Paul 244 metres south of 'Keigwin' at OSGR SW 3790/2707.

ii) Adding a length of Restricted Byway in the Parish of Sennen from a Restricted Byway in moiety in the Parishes of St Buryan, Lamorna & Paul and Sennen to be added by this Order, 224 metres west-south-west of 'Keigwin' at OSGR SW 3768/2726, then running in a west-south-westerly, then north-north-westerly direction for 407 metres terminating at its junction with Classified Road A30 559 metres west-south-west of 'Keigwin' at OSGR SW 3735/2719.

A copy of the Order & Map has been placed & may be seen free of charge at Penzance Library & Information Service, St John's Hall, Penzance, TR18 2QW, from 9am-5pm on Monday to Friday & from 10am-1pm on Saturday. A copy may also be viewed at the Offices of Cornwall Council at New County Hall, Treyew Road, Truro, TR1 3AYfrom 9am to 5pm, from Monday to Friday.

Any representation or objection relating to the Order must be sent in writing to the Public Rights of Way Team Leader, Cornwall Council Regulatory Services, New County Hall, Truro TR1 3AY (quoting Reference WCA 840/841) not later than 13 November 2026 stating the grounds on which they are made. If no representations of objections are duly made to the Order, (orto any part of it), or if any so made are withdrawn, the Cornwall Council, instead of submitting the Order to the Secretary of State (or part of it if the authority has by notice to the Secretary of State so elected under paragraph 5 of Schedule 15 to the Wildlife & Countryside Act 1981) may itself confirm the Order (or that part of the Order). If the Order is submitted to the Secretary of State (in whole or in part) any representations or objections which have not been withdrawn will be sent with it.
