WILDLIFE & COUNTRYSIDE ACT 1981 • SECTION 53
THE DEFINITIVE MAP & STATEMENT FOR THE FORMER PENWITH DISTRICT AREA

THE CORNWALL COUNCIL (ADDITION OF A RESTRICTED BYWAY AT CHAPEL CARN BREA IN THE TOWN OF ST JUST AND THE PARISH OF ST SURYAN, LAMORNA & PAUL) MODIFICATION ORDER 2026

The above Order made on 24 September 2026, if confirmed as made, will modify the definitive map & statement for the area by:

Adding a length ofRestricted Byway in moiety in the Town of St Just and the Parish of St Buryan, Lamorna & Paul from Classified Road C157, 124 metres north of 'Bolankan House' at Ordnance Survey Grid Reference (OSGR) SW 3891/2833 then running in a west-south-westerly, then southerly, then south-south-westerly direction for 750 metres to its junction with Footpath 14 St Just and Footpath 104 St Buryan, Lamorna & Paul at OSGR SW 3853/2775, then running in a south-south-westerly direction for 94 metres to its junction with Footpath 4 St Just at OSGR SW 3850/2766, then running in a south-south-westerly, then south-westerly, then west-south-westerly direction for 355 metres terminating at its junction with Classified Road A30 10 metres south-west of 'Newshop Cottage' at OSGR SW 3828/27 41.

A copy of the Order & Map has been placed & may be seen free of charge at Penzance Library & Information Service, St John's Hall, Penzance, TR18 2QW, from 9am-5pm on Monday to Friday & from 10am-1pm on Saturday. A copy may also be viewed at the Offices of Cornwall Council at New County Hall, Treyew Road, Truro, TR1 3AYfrom 9amto 5pm, from Monday to Friday.

Any representation or objection relating to the Order must be sent in writing to the Public Rights of Way Team Leader, Cornwall Council Regulatory Services, New County Hall, Truro TR1 3AY (quoting Reference WCA 630) not later than 13 November 2026 stating the grounds on which they are made. If no representations of objections are duly made to the Order, (orto any part of it), or if any so made are withdrawn, the Cornwall Council, instead of submitting the Order to the Secretary of State (or part of it if the authority has by notice to the Secretary of State so elected under paragraph 5 of Schedule 15 to the Wildlife & Countryside Act 1981) may itself confirm the Order (or that part of the Order). If the Order is submitted to the Secretary of State (in whole or in part) any representations or objections which have not been withdrawn will be sent with it.
