NOTICE OF THE GIVING OF A CERTIFICATE UNDER SECTION 19 OF THE ACQUISITION OF LAND ACT 1981
1. The Cambourne to Cambridge Order (“the Order”), which was submitted by Cambridgeshire County Council and is to be made by Secretary of State for Transport, includes the land described in Part A of the Schedule (hereinafter referred to as the “order land”).
2. The order land forms part of an open space, as defined in the Acquisition of Land Act 1981; that is, land laid out as a public garden, or used for the purposes of public recreation.
3. Notice hereby given that the Secretary of State in exercise of her powers under section 19 of the Acquisition of Land Act 1981 has certified that she is satisfied that there has been or will be given in exchange for the order land other land (“the exchange land”) which is not less in area and is equally advantageous to persons, if any, entitled to rights of common or other rights, and to the public, and that the exchange land has been or will be vested in the persons in whom the order land was vested, and subject to the like rights, trusts and incidents as attach to the order land.
4. A map showing the land to which the certificate relates and the land proposed to be given in exchange may be inspected at Cambridge City Council, Mandela House, 4 Regent Street, Cambridge CB2 1LY at all reasonable hours.
5. The certificate becomes operative on the date on which this notice is first published. A person aggrieved by the certificate may, by application to the High Court within 6 weeks from that date, challenge its validity on the ground that there has been a failure to comply with any relevant statutory requirement relating to the certificate.
