HYSBYSIR drwy hyn fod Cyngor Bwrdeistref Sirol Merthyr Tudful, drwy arfer ei bwerau o dan Adrannau 1, 2, 4, 45, 46, 49 a 53 o Ddeddf Rheoleiddio Traffig Ffyrdd 1984, Rhan 6 o Ddeddf Rheoli Traffig 2004, Rheoliadau Gorfodi Sifil ar Dramgwyddau Traffig Ffyrdd (Darpariaethau Cyffredinol) (Cymru) 2013 ac o bob pwˆer arall sy’n ei alluogi yn hynny o bryd ac ar ôl ymgynghori â’r Prif Swyddog, Mae Heddlu De Cymru, yn unol â Rhan Ill o Atodlen 9 i Ddeddf 1984 wedi gwneud y Gorchymyn a ganlyn, a ddisgrifir ei effaith gyffredinol isod. Daeth y Gorchymyn i rym ar 31 Awst 2026 ac mae effaith y Gorchymyn fel a ganlyn: -

1. Mae pob rhan ar y briffordd y cyfeirir ati yn Atodlen 1 i’r Gorchymyn hwn wedi’i dynodi’n Fan Parcio Cerbydau Trydan.

2. Amrywio’r Gorchymyn a bennir yn Atodlen 2.

3. Ac eithrio fel y darperir gan y Gorchymyn hwn neu ar gyfarwyddyd neu gyda chaniatâd cwnstabl heddlu mewn gwisg neu Swyddog Gorfodi Sifil, ni chaiff unrhyw berson beri na chaniatáu i unrhyw Gerbyd aros ar unrhyw adeg mewn Man Parcio Cerbydau Trydan.

4. Ni fydd Erthygl 3 yn ei gwneud hi’n anghyfreithlon i Gerbyd Trydan aros yn y Man Parcio Cerbydau Trydan (at ddibenion defnyddio’r Ddyfais Codi Tâl i wefru’r Cerbyd Trydan yn unig) am gyfnod o 2 awr ar uchafswm o 2 awr os yw cyfnod o fwy na 2 awr wedi mynd heibio ers diwedd y cyfnod olaf o wefru’r Cerbyd Trydan yn y Man Parcio Cerbydau Trydan.
Eithriadau

5. (i) Ni fydd Erthygl 3 yn gymwys i: -

(a) Cerbyd Cynnal a Chadw a awdurdodwyd gan y Darparwr Gwasanaeth i aros i mewn unrhyw un o’r rhannau o ffordd y cyfeirir atynt felly cyhyd ag y bo’n angenrheidiol i gynnal, atgyweirio a rheoli’r Pwyntiau Codi Tâl o fewn y Man Parcio Cerbydau Trydan;

(b) Cerbyd sy’n cael ei ddefnyddio at ddibenion brigâd dân neu ambiwlans neu Gerbyd (ac eithrio cerbyd teithwyr) yng ngwasanaeth heddlu yn y naill achos neu’r llall yn cael ei ddefnyddio yn unol â phwerau neu ddyletswyddau statudol;

(c) Cerbyd sy’n aros oherwydd bod y gyrrwr yn cael ei atal rhag mynd ymlaen gan amgylchiadau y tu hwnt i’w reolaeth neu i aros o’r fath fod yn angenrheidiol er mwyn osgoi damwain;

(ii) Ni fydd Erthygl 3 yn gymwys i Gerbydau sy’n aros cyhyd ag y bo’n angenrheidiol bosibl yn unig:-

(a) i ollwng pobl neu adael y Cerbyd;

(b) i alluogi nwyddau i gael eu llwytho a’u dadlwytho o Gerbyd;

(c) er mwyn galluogi’r cerbyd i gael ei ddefnyddio mewn cysylltiad ag unrhyw un o’r dibenion canlynol os na ellir ei ddefnyddio at y diben hwnnw mewn unrhyw ddarn arall o ffordd: -

i) mewn cysylltiad ag unrhyw weithrediad adeiladu neu ddymchwel;

ii) cael gwared ar unrhyw rwystr i draffig;

iii) ynnal a chadw, gwella neu ailadeiladu unrhyw ran, neu rhannau o unrhyw ffordd sy’n cynnwys Man Parci CerbydTrydan; neu

iv) gosod, codi, newid neu atgyweirio mewn neu gerllaw unrhyw un o’r ffyrdd uchod unrhyw garthffos neu unrhyw brif bibell neu gyfarpar ar gyfer cyflenwi nwy, dwˆr neu drydan, neu unrhyw telathrebu cyfarpar yn unol â Deddf Telathrebu 1984 (fel y’i diwygiwyd) neu osod, cynnal a chadw neu dynnu unrhyw arwydd traffig.

(d) fel rhan o osgordd angladd neu fel arall mewn cysylltiad ag angladd ar yr amod bod y cerbyd yn eiddo i drefnydd angladdau neu berchennog o gerbydau angladd;

(e) galluogi cerbyd Swyddfa’r Post i gael ei ddefnyddio at ddibenion dosbarthu neu gasglu pecynnau post fel y’i diffinnir yn Neddf Gwasanaethau Post 2000 yn unig

(f) galluogi cerbyd gorfodi sifil i gyflawni gorfodi Tramgwyddau Traffig Ffyrdd yn unol â Rhan 6 o Reoliadau 2004 a 2013

(g) i alluogi cerbyd i gyflawni cyflenwi neu gasglu bwliwn neu symiau sylweddol o arian neu arian parod, pan fo’r cerbyd hwnnw’n gerbyd diogelwch pwrpasol ac yn hawdd ei adnabod fel cerbyd diogelwch a weithredir gan bersonél diogelwch mewn gwisg

6. Gellir archwilio’r Gorchymyn, ynghyd â datganiad o’r rhesymau a’r cynllun sy’n dangos y ffyrdd yr effeithir arnynt, yn swyddfeydd y Cyngor yn Uned 5, Parc Busnes Triongl, Pentrebach, Merthyr Tudful CF48 4TQ yn ystod oriau swyddfa arferol.

7. Os yw unrhyw berson yn dymuno cwestiynu dilysrwydd y Gorchymyn, neu unrhyw un o’i ddarpariaethau ar y sail nad yw ef neu hwy o fewn y pwerau a roddwyd gan Ddeddf Rheoleiddio Traffig Ffyrdd 1984 (fel y’i diwygiwyd), neu nad yw unrhyw ofyniad o’r Ddeddf, neu unrhyw offeryn a wneir oddi tano, wedi’i gydymffurfio, caiff y person hwnnw o fewn chwe wythnos o’r dyddiad y gwneir y Gorchymyn, wneud cais i’r Uchel Lys at y dibenion hyn. Gwnaed y Gorchymyn ar 19 Awst 2026.

MERTHYR TYDFIL COUNTY BOROUGH COUNCIL
REAR OF NOS. 137-139 HIGH STREET, MERTHYR TYDFIL
(ELECTRIC VEHICLE PARKING PLACE) (VARIATION) ORDER 2026

NOTICE is hereby given that Merthyr Tydfil County Borough Council in exercise of its powers under Sections 1, 2, 4, 45, 46, 49 and 53 of the Road Traffic Regulation Act 1984, Part 6 of the Traffic Management Act 2004, The Civil Enforcement of Road Traffic Contraventions (General Provisions) (Wales) Regulations 2013 and of all other powers enabling it in that behalf and after consultation with the Chief Officer, South Wales Police, in accordance with Part Ill of Schedule 9 to the said Act of 1984 has made the following Order, the general effect of which is described below.

The Order came into effect on 31st August 2026 and the effect of the Order is as follows: -

1. Each area on the highway referred to in Schedule 1 to this Order is designated as an Electric Vehicle Parking Place.

2. Vary the Order specified in Schedule 2.

3. Except as provided by this Order or upon the direction or with the permission of a police constable in uniform or a Civil Enforcement Officer no person shall cause or permit any Vehicle to wait at any time in an Electric Vehicle Parking Place.

4. Article 3 shall not render it unlawful for an Electric Vehicle to wait in the Electric Vehicle Parking Place (solely for the purpose of using the Charging Device to charge the Electric Vehicle) for a maximum period of 2 hours if a period of more than 2 hours has elapsed since the termination of the last period of charging of the Electric Vehicle in the Electric Vehicle Parking Place Exemptions

5. (i) Article 3 shall not apply to: -

(a) a Maintenance Vehicle authorised by the Service Provider to wait in any of the lengths of road so referred to for as long as it may be necessary to maintain, repair and manage the Charging Points within the Electric Vehicle Parking Place;

(b) a Vehicle being used for fire brigade or ambulance purposes or a Vehicle (other than a passenger vehicle) in the service of a police force in either case being used in pursuance of statutory powers or duties;

(c) a Vehicle waiting due to the driver being prevented from proceeding by circumstances beyond his control or to such waiting being necessary in order to avoid an accident;

(ii) Article 3 shall not apply to Vehicles waiting only for as long as may be necessary: -

(a) to enable persons to board or alight from the Vehicle;

(b) to enable goods to be loaded onto and unloaded from a Vehicle;

(c) to enable the vehicle to be used in connection with any of the following purposes if it cannot conveniently be used for such purpose in any other length of road: -

i) in connection with any building operation or demolition;

ii) the removal of any obstruction to traffic;

iii) the maintenance improvement or reconstruction of any part or parts of any road containing an Electric Vehicle Parking Place; or

iv) the laying erection alteration or repair in or near to any of the aforesaid roads of any sewer or of any main pipe or apparatus for the supply of gas water or electricity or of any telecommunication apparatus pursuant to the Telecommunications Act 1984 (as amended) or the placing maintenance or removal of any traffic sign.

(d) as part of a funeral cortege or otherwise in connection with a funeral provided the vehicle is owned by a funeral director or by an owner of funeral vehicles;

(e) to enable a Post Office vehicle to be used solely for the purpose of delivering or collecting postal packets as defined in the Postal Services Act 2000

(f) to enable a civil enforcement vehicle to carry out the enforcement of Road Traffic Contraventions pursuant to Part 6 of the 2004 and the 2013 Regulations

(g) to enable a vehicle to carry out the delivery or collection of bullion or substantial quantities of money or cash, where that vehicle is a purpose built security vehicle and easily identified as a security vehicle operated by uniformed security personnel

6. The Order together with a statement of reasons and plan showing the affected roads may be inspected at the Council’s offices at Unit 5, Triangle Business Park, Pentrebach, Merthyr Tydfil CF48 4TQ during normal office hours.

7. If any person wishes to question the validity of the Order, or any of its provisions on the ground that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984 (as amended), or that any requirement of the Act, or of any instrument made under it has not been complied with, that person may within six weeks from the date on which the Order is made, apply to the High Court for these purposes. The Order was made on 19th August 2026.

The eastern side from a point 15 metres north of its junction with the northern side of Swan Street to a point 15 metres south of its junction with the southern side of the access road connecting to the Service Area at rear of nos. 136 to 139 High Street.
