HYSBYSIR gyda hyn fod Cyngor Bwrdeistref Sirol Merthyr Tudful, drwy arfer ei bwerau o dan Adrannau 1(1) a 2(1) i (3) o Ddeddf Rheoleiddio Traffig Ffyrdd 1984, Rhan 6 o Ddeddf Rheoli Traffig 2004, Rheoliadau Gorfodi Sifil ar Dramgwyddau Traffig Ffyrdd (Darpariaethau Cyffredinol) (Cymru) 2013 a phob pwˆer galluogol arall ac ar ôl ymgynghori â’r Prif Swyddog, fod Heddlu De Cymru, yn unol â Rhan Ill o Atodlen 9 i Ddeddf 1984 wedi gwneud y Gorchymyn a ganlyn. Disgrifir ei effaith gyffredinol isod. Daeth y Gorchymyn i rym ar 31 Awst 2026. Mae effaith y Gorchymyn fel a ganlyn: -
1. Ac eithrio fel y darperir yn Erthyglau 3(1), 3(2), 4(1), 4(2), 5, 6 a 7, ni chaiff neb beri i unrhyw gerbyd aros ar unrhyw adeg ar y darnau ac ochrau darnau o ffordd a bennir yn Atodlen 1.
2. Ac eithrio fel y darperir yn Erthyglau 3(1), 3(2), 5, 6(g) a 6(h), ni chaiff neb beri i unrhyw gerbyd stopio neu aros ar unrhyw adeg ar y darnau ac ochrau darnau o ffordd a bennir yn Atodlen 2.

EITHRIADAU RHAG GWAHARDDIADAU A CHYFYNGIADAU
3(1) Ni fydd unrhyw beth yn y gorchymyn hwn yn berthnasol i unrhyw beth a wneir gyda chaniatâd neu ar gyfarwyddyd Swyddog Heddlu mewn Gwisg.
3(2) Ni fydd unrhyw beth yn y gorchymyn hwn yn gymwys i gerbyd sy’n cael ei ddefnyddio at ddibenion ambiwlans, tân neu heddlu mewn perthynas ag argyfwng neu wrth gyflawni dyletswyddau neu ddibenion yr heddlu os byddai cadw’r ddarpariaeth honno yn debygol o rwystro’r defnydd o’r cerbyd hwnnw at y diben y mae’n cael ei ddefnyddio ar yr achlysur hwnnw.

LLWYTHO A DADLWYTHO NWYDDAU
4(1) Ni fydd unrhyw beth yn Erthygl 1 yn ei gwneud hi’n anghyfreithlon achosi neu ganiatáu i gerbyd aros mewn unrhyw ffordd gyfyngedig sydd wedi’u dynodi neu eu hawdurdodi ac a ddisgrifir yn atodlen 1 cyhyd ag y bo’n angenrheidiol i alluogi nwyddau i gael eu llwytho ar y cerbyd neu eu dadlwytho.
4(2) Er gwaethaf unrhyw beth ym mharagraff 1Bydd rhaid i yrrwr cerbyd sy’n aros at ddibenion dosbarthu neu gasglu nwyddau neu lwytho neu ddadlwytho’r cerbyd symud y cerbyd ar gyfarwyddydSwyddog o’r Heddlu mewn Gwisg neu Swyddog Gorfodi Sifil pryd bynnag y pennir fod symud yn angenrheidiol at ddibenion atal rhwystr.

ESEMPTIAD CYFFREDINOL RHAG GWAHARDDIADAU A CHYFYNGIADAU
5 Ni fydd unrhyw beth yn Erthyglau 1 a 2 yn ei gwneud hi’n anghyfreithlon achosi neu ganiatáu i gerbyd aros mewn ffordd gyfyngedig cyhyd ag y bo’n angenrheidiol i alluogi’r cerbyd
a) os na ellir ei defnyddio’n gyfleus at ddibenion o’r fath mewn ffordd arall i’w defnyddio mewn cysylltiad â
i) cael gwared ar unrhyw rwystr i draffig
ii) cynnal a chadw, ailadeiladu neu wella hyd y ffordd
iii) gosod, codi, newid neu atgyweirio mewn neu ger unrhyw un o’r darnau o ffordd gyfleusterau carthffosiaeth, prif bibell neu gyfarpar ar gyfer cyflenwi nwy, dwˆr, trydan neu gyfarpar telathrebu fel y’i diffinnir yn Atodlen 2 o’r Deddf Telathrebu 1984
iv) gweithrediadau adeiladu, diwydiannol neu ddymchwel ar yr amod bod hysbysiad ar bapur pennawd busnes sy’n nodi manylion cyswllt o ble y gellir lleoli’r gyrrwr yn cael ei arddangos ar sgrin wynt ac ar yr amod na fydd yr esemptiad hwn yn gymwys i Erthygl 2
b) os na ellir ei defnyddio’n gyfleus mewn ffordd arall i’w defnyddio yng ngwasanaeth awdurdod lleol neu awdurdod dwˆr yn unol â phwerau neu ddyletswyddau statudol
c) i’w ddefnyddio at y diben a awdurdodwyd gan ac a ddisgrifir ar ryddhad neu drwydded a gyhoeddwyd gan yr awdurdod cyhoeddi ar yr amod bod y caniatâd neu’r drwydded honno yn weladwy yn glir trwy sgrin wynt y cerbyd ar y dangosfwrdd.
6 Ni fydd unrhyw beth yn Erthygl 1 yn ei gwneud hi’n anghyfreithlon achosi neu ganiatáu i gerbyd aros mewn ffordd gyfyngedig cyhyd ag y bo’n angenrheidiol i alluogi
a) person i esgyn neu i ddisgyn o’r cerbyd neu i lwytho neu ddadlwytho bagiau personol
b) cerbyd hacni i’w logi ar safle tacsi a awdurdodwyd yn briodol yn unol â Deddf Llywodraeth Leol (Darpariaethau Amrywiol) 1976
c) cerbyd sydd i’w ddefnyddio at ddibenion dosbarthu neu gasglu pecynnau post fel y’i diffinnir yn adran 4(3) o Ddeddf Gwasanaethau Post 2000
d) prif gerbyd i aros mewn neu ger unrhyw fangre sydd wedi’i lleoli ar neu gyfagos i unrhyw un o’r darnau o ffordd dywededig cyhyd ag y mae aros gan y cerbyd hwnnw yn rhesymol angenrheidiol mewn cysylltiad â phriodas neu angladd
e) cerbyd i gymryd petrol, olew, dwˆr neu aer o garej sydd wedi’i leoli ar y darn hwnnw o ffordd neu’n gyfagos iddo
f) bws i aros ar fae bysiau wedi’i farcio
g) cerbyd i aros os yw’n ofynnol yn ôl y gyfraith i stopio neu os yw’r gyrrwr yn cael ei atal rhag mynd ymlaen gan amgylchiadau y tu hwnt i’w reolaeth neu er mwyn osgoi damwain
h) cerbyd sy’n mynychu argyfwng meddygol gan feddyg, nyrs ardal, bydwraig, neu weithiwr cymdeithasol penodedig ac yn yr achosion hynny gall y Cyngor ofyn am dystiolaeth ysgrifenedig o argyfwng gwirioneddol.

CERBYDAU PERSONAU ANABL
7 Ni fydd unrhyw beth yn Erthygl 1 yn gwneud perchennog cerbyd yn agored i gosb drwy achosi neu ganiatáu i gerbyd person anabl sy’n arddangos yn y safle perthnasol fathodyn person anabl a disg parcio (y mae’r gyrrwr, neu berson arall sy’n gyfrifol am y cerbyd, wedi marcio’r amser y dechreuodd y cyfnod aros) aros yn unrhyw un o’r ffyrdd, darnau o ffordd neu ochrau darnau o ffordd y cyfeirir atynt yn y gwahanol rannau o Atodlen 1 am uchafswm o 3 awr yn ystod y cyfnod gweithredu perthnasol nad yw’n gyfnod sydd wedi’i wahanu gan egwyl o lai nag 1 awr o aros blaenorol gan yr un cerbyd ar y darn hwnnw o ffordd.

8 Er mwyn osgoi amheuaeth, ni chaniateir i gerbyd person anabl aros neu stopio mewn unrhyw ddarn o ffordd y cyfeirir ato yn erthygl 2.

9. Y Gorchymyn ynghyd â datganiad o’r rhesymau a’r cynllun sy’n dangos y ffyrdd yr effeithir arnynt yn cael eu harchwilio yn swyddfeydd y Cyngor yn Uned 5, Parc Busnes Triongl, Pentrebach, Merthyr Tudful CF48 4TQ yn ystod oriau swyddfa arferol.

10. Os yw unrhyw berson yn dymuno cwestiynu dilysrwydd y Gorchymyn, neu unrhyw un o’i ddarpariaethau ar y sail nad yw o fewn y pwerau a roddwyd gan Ddeddf Rheoleiddio Traffig Ffyrdd 1984 (fel y’i diwygiwyd), neu nad yw unrhyw ofyniad y Ddeddf, neu unrhyw offeryn a wnaed oddi tano, caiff y person hwnnw o fewn chwe wythnos o’r dyddiad y gwneir y Gorchymyn, wneud cais i’r Uchel Lys at y dibenion hyn. Gwnaed y Gorchymyn ar 24 Awst 2026.

AMSERLENNI
ATODLEN 1 – GWAHARDD AROS AR UNRHYW ADEG
1) Ochr dde-ddwyreiniol Heol Galon Uchaf sy’n arwain i mewn i Heol Gwaunfarren o’r gyffordd ag ochr ddeheuol Clôs Thomas Dyke am bellter o 140 metri gyfeiriad y de-orllewin
2) Ochr ogledd-orllewinol Heol Galon Uchaf sy’n arwain i mewn i Heol Gwaunfarren o bwynt 7 metr i’r gogledd o’i chyffordd gyferbyn ag ochr ddeheuol Clôs Thomas Dyke am bellter o 147 metr i gyfeiriad y de-orllewin
3) Ochr ogledd-orllewinol Heol Gwaunfarren o bwynt 10 metr i’r gogledd-ddwyrain o’r gyffordd gyferbyn ag ochr ogleddol y rhan o Heol Gwaunfarren sy’n ymestyn i’r dwyrain tuag at Cilgant Brenhinol am bellter o 37 metr i gyfeiriad y de-orllewin.
4) Ochr dde-ddwyreiniol Heol Gwaunfarren o’i chyffordd ag ochr ogleddol y rhan o Heol Gwaunfarren sy’n ymestyn i’r dwyrain tuag at y Cilgant Brenhinol, am bellter o 10 metr i gyfeiriad y gogledd-ddwyrain.
5) Ochr dde-ddwyreiniol Heol Gwaunfarren o’i chyffordd ag ochr ddeheuol y rhan o Heol Gwaunfarren sy’n ymestyn i’r dwyrain tuag at y Cilgant Brenhinol, am bellter o 13 metr i gyfeiriad y de-orllewin.
6) Y ddwy ochr i’r rhan o Heol Gwaunfarren sy’n ymestyn i’r dwyrain tuag at y Cilgant Brenhinol, o’i chyffordd â Heol Gwaunfarren, am bellter o 16 metr i gyfeiriad y dwyrain.
7) Ochr ddeheuol y rhan o Heol Gwaunfarren sy’n ymestyn i’r dwyrain tuag at Royal Crescent, o bwynt 50 metr i’r dwyrain o’i chyffordd â Heol Gwaunfarren am bellter o 43 metr i gyfeiriad y dwyrain.

ATODLEN 2 – GWAHARDD STOPIO AR UNRHYW ADEG-CLIRFFYRDD
1) Y ddwy ochr i Heol Gwaunfarren o bwynt 140 metr i’r de a’i chyffordd ag ochr ddeheuol Clôs Thomas Dyke am bellter o 200 metr i gyfeiriad y de.
2) Dwy ochr Heol Gwaunfarren o bwynt 10 metr i’r gogledd o’r gyffordd â’r rhan o Heol Gwaunfarren sy’n ymestyn i’r dwyrain tuag at y Cilgant Brenhinol, am bellter o 83 metr i gyfeiriad y gogledd.

MERTHYR TYDFIL COUNTY BOROUGH COUNCIL
GALON UCHAF ROAD, GALON UCHAF AND GWAUNFARREN ROAD, PENYDARREN, MERTHYR TYDFIL
(PROHIBITION OF WAITING AT ANY TIME) (PROHIBITION OF STOPPING AT ANY TIME-CLEARWAYS) ORDER 2026

NOTICE is hereby given that Merthyr Tydfil County Borough Council in exercise of its powers under Sections 1(1) and 2(1) to (3) of the Road Traffic Regulation Act 1984, Part 6 of the Traffic Management Act 2004, The Civil Enforcement of Road Traffic Contraventions (General Provisions) (Wales) Regulations 2013 and of all other powers enabling it in that behalf and after consultation with the Chief Officer, South Wales Police, in accordance with Part Ill of Schedule 9 to the said Act of 1984 has made the following Order, the general effect of which is described below. The Order came into force on 31st August 2026. The effect of the Order is as follows: -
1. Save as provided in Articles 3(1), 3(2), 4(1), 4(2), 5, 6 and 7 no person shall cause any vehicle to wait at any time on the lengths and sides of lengths of road specified in Schedule 1.
2. Save as provided in Articles 3(1), 3(2) 5, 6(g) and 6(h) no person shall cause any vehicle to stop or remain at rest at any time on the lengths and sides of lengths of road specified in Schedule 2.

EXEMPTIONS FROM PROHIBITIONS & RESTRICTIONS
3(1) Nothing in this order shall apply to anything done with the permission or at the direction of a Police Officer in Uniform.
3(2) Nothing in this order shall apply to a vehicle being used for ambulance, fire or police purposes in relation to an emergency or whilst in pursuit of duties or police purposes if the observance of that provision would be likely to hinder the use of that vehicle for the purpose for which it is being used on that occasion.

LOADING AND UNLOADING OF GOODS
4(1) Nothing in Article 1 shall make it unlawful to cause or permit a vehicle to wait in any restricted road which is designated or authorised and described in schedule 1 for so long as may be necessary to enable goods to be loaded onto or unloaded from the vehicle.
4(2) Notwithstanding anything in paragraph 1 The driver of a vehicle waiting for the purposes of delivering or collecting goods or loading or unloading the vehicle shall move the vehicle on the instruction of a Police Officer in Uniform or Civil Enforcement Officer whenever such moving may be necessary for the purposes of preventing obstruction.

GENERAL EXEMPTION FROM PROHIBITIONS AND RESTRICTIONS
5 Nothing in Articles 1 and 2 shall make it unlawful to cause or permit a vehicle to wait in a restricted road for so long as may be necessary to enable the vehicle
a) if it cannot conveniently be used for such purposes in another road to be used in connection with
i) the removal of any obstruction to traffic
ii) the maintenance, reconstruction or improvement to the length of road
iii) the laying, erection, alteration or repair in or near any of the lengths of road of a sewer, main pipe or apparatus for the supply of gas, water, electricity or telecommunications apparatus as defined in schedule 2 of the Telecommunications Act 1984
iv) building, industrial or demolition operations provided that a notice on business headed
paper stating contact details of where the driver can be located is displayed on the indscreen of the vehicle and provided that this exemption shall not apply to Article 2
b) if it cannot conveniently be used in another road to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties
c) to be used for the purpose authorised by and described on a dispensation or permit issued by the issuing authority provided such dispensation or permit is clearly visible through the windscreen of the vehicle on the dashboard.
6 Nothing in Article 1 shall make it unlawful to cause or permit a vehicle to wait in a restricted road for so long as may be necessary to enable
a) a person to board or alight from the vehicle or to load or unload personal luggage
b) a hackney carriage to be on hire upon a duly authorised taxi rank in accordance with the Local Government (Miscellaneous Provisions) Act 1976
c) the vehicle to be used for the purpose of delivering or collecting postal packets as defined in section 4(3) of the Postal Services Act 2000
d) the principal vehicle to wait at or near to any premises situated on or adjacent to any of the said lengths of road for so long as waiting by that vehicle is reasonably necessary in connection with a wedding or funeral
e) the vehicle to take in petrol, oil, water or air from a garage situated on or adjacent to the said length of road
f) a bus to wait on a marked bus bay
g) the vehicle to wait if required by law to stop or if the driver is being prevented from proceeding by circumstances beyond their control or in order to avoid an accident
h) a vehicle attending a medical emergency by a doctor, district nurse, midwife, or appointed social worker in which cases the Council may request written evidence of a genuine emergency.

DISABLED PERSONS VEHICLES
7 Nothing in Article 1 shall make the owner of a vehicle liable to a penalty charge by causing or permitting a disabled persons vehicle which displays in the relevant position a disabled persons badge and a parking disc (on which the driver, or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait in any of the roads, lengths of road or sides of lengths of road referred to in the various parts of Schedule 1 for a maximum of 3 hours during the relevant operation period not being a period separated by an interval of less than 1 hour from a previous waiting by the same vehicle in that length of road.
8 For the avoidance of doubt a disabled persons vehicle is not permitted to wait or stop in any length of road referred to in article 2.
9. The Order together with a statement of reasons and plan showing the affected roads may be inspected at the Council’s offices at Unit 5, Triangle Business Park, Pentrebach, Merthyr Tydfil CF48 4TQ during normal office hours.
10. If any person wishes to question the validity of the Order, or any of its provisions on the ground that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984 (as amended), or that any requirement of the Act, or of any instrument made under it has not been complied with, that person may within six weeks from the date on which the Order is made, apply to the High Court for these purposes. The Order was made on 24th August 2026.

SCHEDULES
SCHEDULE 1 – PROHIBITION OF WAITING AT ANY TIME
1) The south-eastern side of Galon Uchaf Road leading into Gwaunfarren Road from its junction with the southern side of Thomas Dyke Close for a distance of 140 metresin a south-westerly direction
2) The north-western side of Galon Uchaf Road leading into Gwaunfarren Road from a point 7 metres north of its opposite junction with the southern side of Thomas Dyke Close for a distance of 147 metres in a south-westerly direction
3) The north-western side of Gwaunfarren Road from a point 10 metres north-east of its opposite junction with the northern side of the section of Gwaunfarren Road extending east towards Royal Crescent, for a distance of 37 metres in a south-westerly direction.
4) The south-eastern side of Gwaunfarren Road from its junction with the northern side of the section of Gwaunfarren Road extending east towards Royal Crescent, for a distance of 10 metres in a north-easterly direction.
5) The south-eastern side of Gwaunfarren Road from its junction with the southern side of the section of Gwaunfarren Road extending east towards Royal Crescent, for a distance of 13 metres in a south-westerly direction.
6) Both sides of the section of Gwaunfarren Road extending east towards Royal Crescent, from its junction with Gwaunfarren Road, for a distance of 16 metres in an easterly direction.
7) The southern side of the section of Gwaunfarren Road extending east towards Royal Crescent, from a point 50 metres east of its junction with Gwaunfarren Road for a distance of 43 metres in an easterly direction.

SCHEDULE 2 – PROHIBITION OF STOPPING AT ANY TIME-CLEARWAYS
1) Both sides of Gwaunfarren Road from a point 140 metres south its junction with the southern side of Thomas Dyke Close for a distance of 200 metres in a southerly direction.
2) Both sides of Gwaunfarren Road from a point 10 metres north of its junction with the section of Gwaunfarren Road extending east towards Royal Crescent, for a distance of 83 metres in a northerly direction.
