PUBLIC DIVERSION ORDER 2026
On 26th August 2026 The Borough Council of Pendle confirmed without modification the above order made under section 119 of the Highways Act 1980. The effect of the order is that it will divert the public bridleway commencing from a point north of Duck Pond Farm Cottage at grid reference SD 8653 4477 (Point A) running South East for 80 metres to a point on FP1301042 at grid reference SD 8659 4473 (Point C) and then running SW on the line of FP1301042 for 35 metres to a point East of Duck Pond Farm Cottage grid reference SD 8657 4470 (point B). Width: 4.0 metres wide.
A copy of the order and the order map have been placed and may be seen free of charge at Number 1 Market Street, Nelson, during usual business hours. Copies of the order and map may be bought there at the price of £1. The order comes into force as from 26th August 2026 but if any person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 4th September 2026, make an application to the High Court.
