HYSBYSIR gyda hyn fod Cyngor Bwrdeistref Sirol Merthyr Tudful, drwy arfer ei bwerau o dan Adrannau 1(1) a 2(1) i (3) o Ddeddf Rheoleiddio Traffig Ffyrdd 1984, Rhan 6 o Ddeddf Rheoli Traffig 2004, Rheoliadau Gorfodi Sifil ar Dramgwyddau Traffig Ffyrdd (Darpariaethau Cyffredinol) (Cymru) 2013 a phob pŵer galluogol arall ac ar ôl ymgynghoriad â’r Prif Swyddog, Heddlu De Cymru ac yn unol â Rhan Ill o Atodlen 9 i Ddeddf 1984, yn bwriadu gwneud y Gorchymyn a ganlyn a ddisgrifir ei effaith gyffredinol, isod. Mae effaith y Gorchymyn fel a ganlyn: -

1. Ac eithrio fel y darperir yn Erthyglau 3(1), 3(2), 4(1), 4(2), 5, 6 a 7, ni chaiff neb beri i unrhyw gerbyd aros ar unrhyw adeg ar y darnau ac ochrau darnau o ffordd a bennir yn Atodlen 1.

2. Ac eithrio fel y darperir yn Erthyglau 3(1), 3(2), 5, 6(g) a 6(h), ni chaiff neb beri i unrhyw gerbyd stopio neu aros yn gorffwys ar unrhyw adeg ar y darnau ac ochrau darnau o ffordd a bennir yn Atodlen 2.

EITHRIADAU RHAG GWAHARDDIADAU A CHYFYNGIADAU
3(1) Ni fydd unrhyw beth yn y gorchymyn hwn yn berthnasol i unrhyw
beth a wneir gyda chaniatâd neu ar gyfarwyddyd Swyddog Heddlu
mewn iwnifform.

3(2) Ni fydd unrhyw beth yn y gorchymyn hwn yn gymwys i gerbyd sy’n cael ei ddefnyddio at ddibenion ambiwlans, tân neu heddlu mewn perthynas ag argyfwng neu wrth gyflawni dyletswyddau neu ddibenion yr heddlu os byddai cadw’r ddarpariaeth honno yn debygol o rwystro’r defnydd o’r cerbyd hwnnw at y diben y mae’n cael ei ddefnyddio ar yr achlysur hwnnw.

LLWYTHO A DADLWYTHO NWYDDAU
4(1) Ni fydd unrhyw beth yn Erthygl 1 yn ei gwneud hi’n anghyfreithlon achosi neu ganiatáu i gerbyd aros mewn unrhyw ffordd gyfyngedig sydd wedi’i dynodi neu ei hawdurdodi ac a ddisgrifir yn atodlen 1 cyhyd ag y bo’n angenrheidiol i alluogi nwyddau i gael eu llwytho ar y cerbyd neu eu dadlwytho oddi wrtho.

4(2) Er gwaethaf unrhyw beth ym mharagraff 1
Bydd gyrrwr cerbyd sy’n aros at ddibenion dosbarthu neu gasglu nwyddau neu lwytho neu ddadlwytho’r cerbyd yn symud y cerbyd ar gyfarwyddyd yr Heddlu, Swyddog mewn iwnifform neu Swyddog Gorfodi Sifil pryd bynnag y bydd symud yn angenrheidiol at ddibenion atal rhwystr.

ESEMPTIAD CYFFREDINOL RHAG GWAHARDDIADAU A CHYFYNGIADAU

5 Ni fydd unrhyw beth yn Erthyglau 1 a 2 yn ei gwneud hi’n anghyfreithlon achosi neu ganiatáu i gerbyd aros mewn ffordd gyfyngedig cyhyd ag y bo’n angenrheidiol i alluogi’r cerbyd a) os na ellir ei ddefnyddio’n gyfleus at ddibenion o’r fath mewn ffordd arall i’w ddefnyddio mewn cysylltiad â

i) cael gwared ar unrhyw rwystr i draffig

ii) cynnal a chadw, ailadeiladu neu wella hyd y ffordd

iii) gosod, codi, newid neu atgyweirio mewn neu ger unrhyw un o’r darnau o ffordd garthffosiaeth, prif bibell neu gyfarpar ar gyfer cyflenwi nwy, dŵr, trydan neu gyfarpar telathrebu fel y’i diffinnir yn Atodlen 2 o’r Deddf Telathrebu 1984

iv) gweithrediadau adeiladu, diwydiannol neu ddymchwel ar yr amod bod hysbysiad ar bapur pennawd busnes sy’n nodi manylion cyswllt o ble y gellir lleoli’r gyrrwr yn cael ei arddangos ar sgrin wynt y cerbyd ac ar yr amod na fydd yr esemptiad hwn yn gymwys i Erthygl 2

b) os na ellir ei ddefnyddio’n gyfleus mewn ffordd arall i’w ddefnyddio yng ngwasanaeth awdurdod lleol neu awdurdod dŵr yn unol â phwerau neu ddyletswyddau statudol

c) i’w ddefnyddio at y diben a awdurdodwyd gan ac a ddisgrifir ar ryddhad neu drwydded a gyhoeddwyd gan yr awdurdod cyhoeddi ar yr amod bod y drwydded honno yn weladwy yn glir ar sgrin wynt y cerbyd ar y dangosfwrdd.

6 Ni fydd unrhyw beth yn Erthygl 1 yn ei gwneud hi’n anghyfreithlon achosi neu ganiatáu i gerbyd aros mewn ffordd gyfyngedig cyhyd ag y bo’n angenrheidiol i alluogi 

a) person i fynd i mewn neu ddisgyn o’r cerbyd neu lwytho neu ddadlwytho bagiau personol

b) cerbyd hacni i’w logi ar safle tacsi a awdurdodwyd yn briodol yn unol â Deddf Llywodraeth Leol (Darpariaethau Amrywiol) 1976

c) y cerbyd sydd i’w ddefnyddio at ddibenion dosbarthu neu gasglu pecynnau post fel y’i diffinnir yn adran 4(3) o Ddeddf Gwasanaethau Post 2000

d) y prif gerbyd i aros mewn neu ger unrhyw fangre sydd wedi’u lleoli ar neu’n gyfagos i unrhyw un o’r darnau o ffordd dywededig cyhyd ag y bod aros gan y cerbyd hwnnw yn rhesymol angenrheidiol mewn cysylltiad â phriodas neu angladd 

e) y cerbyd i gymryd petrol, olew, dŵr neu aer o garej sydd wedi’i leoli ar y darn hwnnw o ffordd neu’n gyfagos iddo

f) bws i aros ar fae bysiau wedi’i farcio

g) y cerbyd i aros os yw’n ofynnol yn ôl y gyfraith i stopio neu os yw’r gyrrwr yn cael ei atal rhag mynd ymlaen gan amgylchiadau y tu hwnt i’w reolaeth neu er mwyn osgoi damwain

h) cerbyd sy’n mynychu argyfwng meddygol gan feddyg, nyrs ardal, bydwraig, neu weithiwr cymdeithasol penodedig, ac yn yr achosion hynny gall y Cyngor ofyn am dystiolaeth ysgrifenedig o argyfwng gwirioneddol.

MERTHYR TYDFIL COUNTY BOROUGH COUNCIL
GALON UCHAF ROAD, GALON UCHAF AND GWAUNFARREN ROAD, PENYDARREN, MERTHYR TYDFIL

(PROHIBITION OF WAITING AT ANY TIME)
(PROHIBITION OF STOPPING AT ANY TIME-CLEARWAYS) ORDER 2026

NOTICE is hereby given that Merthyr Tydfil County Borough Council in exercise of its powers under Sections 1(1) and 2(1) to (3) of the Road Traffic Regulation Act 1984, Part 6 of the Traffic Management Act 2004, The Civil Enforcement of Road Traffic Contraventions (General Provisions) (Wales) Regulations 2013 and of all other powers enabling it in that behalf and after consultation with the Chief Officer, South Wales Police, in accordance with Part Ill of Schedule 9 to the said Act of 1984 proposes to make the following Order, the general effect of which is described below. The effect of the Order is as follows: -

1. Save as provided in Articles 3(1), 3(2), 4(1), 4(2), 5, 6 and 7 no person shall cause any vehicle to wait at any time on the lengths and sides of lengths of road specified in Schedule 1.

2. Save as provided in Articles 3(1), 3(2) 5, 6(g) and 6(h) no person shall cause any vehicle to stop or remain at rest at any time on the lengths and sides of lengths of road specified in Schedule 2.

EXEMPTIONS FROM PROHIBITIONS & RESTRICTIONS
3(1) Nothing in this order shall apply to anything done with the permission or at the direction of a Police Officer in Uniform.

3(2) Nothing in this order shall apply to a vehicle being used for ambulance, fire or police purposes in relation to an emergency or whilst in pursuit of duties or police purposes if the observance of that provision would be likely to hinder the use of that vehicle for the purpose for which it is being used on that occasion.

LOADING AND UNLOADING OF GOODS
4(1) Nothing in Article 1 shall make it unlawful to cause or permit a vehicle to wait in any restricted road which is designated or authorised and described in schedule 1 for so long as may be necessary to enable goods to be loaded onto or unloaded from the vehicle.

4(2) Notwithstanding anything in paragraph 1
The driver of a vehicle waiting for the purposes of delivering or collecting goods or loading or unloading the vehicle shall move the vehicle on the instruction of a Police Officer in Uniform or Civil Enforcement Officer whenever such moving may be necessary for the purposes of preventing obstruction.

GENERAL EXEMPTION FROM PROHIBITIONS AND RESTRICTIONS
5 Nothing in Articles 1 and 2 shall make it unlawful to cause or permit a vehicle to wait in a restricted road for so long as may be necessary to enable the vehicle

a) if it cannot conveniently be used for such purposes in another road to be used in connection with

i) the removal of any obstruction to traffic

ii) the maintenance, reconstruction or improvement to the length of road

iii) the laying, erection, alteration or repair in or near any of the lengths of road of a sewer, main pipe or apparatus for the supply of gas, water, electricity or telecommunications apparatus as defined in schedule 2 of the Telecommunications Act 1984

iv) building, industrial or demolition operations provided that a notice on business headed paper stating contact details of where the driver can be located is displayed on the windscreen of the vehicle and provided that this exemption shall not apply to Article 2

b) if it cannot conveniently be used in another road to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties

c) to be used for the purpose authorised by and described on a dispensation or permit issued by the issuing authority provided such dispensation or permit is clearly visible through the windscreen of the vehicle on the dashboard.

6 Nothing in Article 1 shall make it unlawful to cause or permit a vehicle to wait in a restricted road for so long as may be necessary to enable

a) a person to board or alight from the vehicle or to load or unload personal luggage 

b) a hackney carriage to be on hire upon a duly authorised taxi rank in accordance with the Local Government (Miscellaneous Provisions) Act 1976

c) the vehicle to be used for the purpose of delivering or collecting postal packets as defined in section 4(3) of the Postal Services Act 2000

d) the principal vehicle to wait at or near to any premises situated on or adjacent to any of the said lengths of road for so long as waiting by that vehicle is reasonably necessary in connection with a wedding or funeral 

e) the vehicle to take in petrol, oil, water or air from a garage situated on or adjacent to the said length of road

f) a bus to wait on a marked bus bay

g) the vehicle to wait if required by law to stop or if the driver is being prevented from proceeding by circumstances beyond their control or in order to avoid an accident

h) a vehicle attending a medical emergency by a doctor, district nurse, midwife, or appointed social worker in which cases the Council may request written evidence of a genuine emergency.
