THE BRENT (WAITING AND LOADING RESTRICTION) (AMENDMENT NO.*) ORDER 202*

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent propose to make the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.

2. The general effect of the ‘Parking Places’ Order would be to:-

(a) introduce permit holders parking places that would operate between 8.30 a.m. and 6.30 p.m. Mondays to Fridays, excluding bank holidays in the street specified in Schedule 1 to this Notice;

(b) specify that:-

(i) each parking place may be used, subject to the provisions of the Order, for the leaving during the permitted hours of such vehicles as are passenger vehicles, goods carrying vehicles, or invalid carriages displaying a valid parking ticket. Motorcycles park free;

(ii) any resident whose usual place of abode is in any street specified in Schedule 2 to this Notice may apply to the Council for the issue of a residents permit valid for use in the parking places specified in Schedule 1 to this Notice, a surcharge would apply for the grant or issue of new or renewed residents’ permits in respect of diesel vehicles, as follows 24 months at £195, for 12 months at £100, for 6 months at £60 and 3 months at £40;

(iii) a maximum of 3 permits per residential postal address would be issued by the Council or its agents, to persons whose usual place of abode is in any street specified in Schedule 3 to this Notice. The charge would be based on a carbon dioxide emissions based sliding charge for passenger vehicles registered on or after 1st March 2001 and on engine size based sliding charge for passenger vehicles registered before 1st March 2001 and qualifying goods carrying vehicles, as specified in Schedule 3 to this Notice. Fully electric vehicles would fall under Band 1;

(iv) car club cars displaying a car club all zone permit would be permitted to park in any permit parking place;

(v) any resident whose usual place of abode is in any street specified in Schedule 2 to this Notice may apply to the Council for the issue of a household visitor permit valid for use in the street for which it is issued for the period between 8.30 a.m. and 6.30 p.m. Mondays to Fridays inclusive, excluding bank holidays. The charge would be based on a carbon dioxide emissions based sliding charge for passenger vehicles registered on or after 1st March 2001 and on engine-size based sliding charge for passenger vehicles registered before 1st March 2001 and qualifying goods carrying vehicles, as specified in Schedule 4 to this Notice;

(vi) any resident whose usual place of abode is in any street or part of any street specified in Schedule 2 to this Notice may apply to the Council for the issue of visitor’s e-permits valid for the period between 8.30 a.m. and 6.30 p.m. Mondays to Fridays, excluding bank holidays at a cost of £1.75 per visitor’s e-permit for a parking period of up to 2 hours on the day of use during permitted hours, £3.50 per visitor’s e-permit for a parking period of up to 4 hours on the day of use during permitted hours and £5.25 per visitor’s e-permit for a parking period exceeding 4 hours on the day of use during permitted hours. No refunds would be made;

(vii) any person who occupies premises in any street specified in Schedule 2 to this Notice and who uses such premises for non-residential purposes may apply to the Council for the issue of a business permit valid for use in the parking places specified in Schedule 1 (Maximum 3 Permits). The charge for each general business permit would be £777 per annum, £467 for 6 months, £311 for 3 months;

(viii) any person who occupies premises in any street specified in Schedule 2 to this Notice and who uses such premises for non-residential purposes may apply to the Council for the issue of a business address permit granted or issued so as to be transferable between multiple vehicles used by one business user in the parking places specified in Schedule 1. The charge for each business permit would be £637 per annum (£383 for 6 months, £254 for 3 months);

(ix) permits issued by the Council to essential users would be valid for use in all the parking bays provided for resident and business users in the AB Zone. The charge for an essential user permit issued in respect of a vehicle used by a person employed by either the NHS, a care organisation recognised by the Council or a registered charity would be £478 per annum, and the charge for an essential user permit issued in respect of a vehicle used by any person would be £637 per annum;

(x) any resident of a “car free” development as defined in a section 106 agreement made under the Town and Country Planning Act 1990 would not be eligible for a residents’ permits in the AB Zone;

(xii) any school who occupies premises in any street specified in Schedule 2 to this Notice and who uses such premises for non-residential purposes may apply to the Council for the issue of a school permit in respect of a vehicle used by a person employed by the school would be £478 per annum during from the beginning of the month in which a permit becomes first valid, provided that a school permit shall only be deemed valid during an academic term.

3. The general effect of the ‘Waiting and Loading Restriction’ Order would be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:

(a) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) would be prohibited at any time in certain lengths of streets specified in Schedule 5 to this Notice;

(b) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) would be prohibited between 8.30 a.m. and 6.30 p.m. Mondays to Fridays inclusive in certain lengths of streets specified in Schedule 6 to this Notice;

(c) waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 40 minutes in the same place would be prohibited at the times and in the lengths of streets specified in Schedules 5 and 6 to this Notice;

(d) the sale or offer for sale of goods from a vehicle would be prohibited (except on Sundays) in the lengths of streets specified in Schedules 5 and 6 to this Notice, unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;

(e) the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising would be prohibited in the lengths of streets specified in Schedules 5 and 6 to this Notice;

(f) any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any vehicle or animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in the lengths of streets specified in Schedules 5 and 6 to this Notice would be revoked.

4. The prohibitions referred to in sub-paragraphs 3(a) to (b) above would not apply in respect of anything done with the permission of or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Blue Badge” would apply.

5. Copies of the proposed Orders, of the relevant Order of 1979 (and of the Orders which have amended that Order), of the Council’s statement of reasons for proposing to make the Orders and of maps which indicate each length of road to which the Orders relate can be inspected during normal office hours on Mondays to Fridays inclusive until the end of a period of 6 weeks from the date on which the Orders are made or the Council decides not to make the Orders at Brent Customer Services, Brent Civic Centre, Engineers Way, Wembley HA9 0FJ.

Riverside Gardens:

(a) the north-east side and the north-west sides, from Nos. 3/4 Riverside Gardens to 6.20 metres south-east of the north-western building wall of Nos. 29/32 Riverside Gardens;

(b) the north-east and north-west sides of the island site situated at the easternmost extremity of Riverside Gardens, from 4.7 metres north-east of the north-eastern kerb-line of the Riverside Gardens to 0.8 metre south of Nos. 47/48 Riverside Gardens;

(c) the south-east side of the island site situated at the easternmost extremity of Riverside Gardens, from 4.2 metres south of Nos. 47/48 Riverside Gardens to 1.1 metres north-east of the south-western boundary of Nos. 49 to 54 and 55 to 60 Riverside Gardens;
