NOTICE OF CONFIRMATION PUBLIC PATH DIVERSION ORDER

THE METROPOLITAN BOROUGH OF BURY (PART OF BRIDLEWAY NUMBER 79, BURY) (TEMPORARY DIVERSION) AND (PUBLIC FOOTPATH 82, BURY & PART OF NUMBER 1, WHITEFIELD) (TEMPORARY STOPPING-UP) ORDER 2026

On 16 June 2026 the Council of the Metropolitan Borough of Bury confirmed the above Order made on 6 March 2026 under sections 257 and 261 of the Town and Country Planning Act 1990.

The effect of the Order as confirmed is to divert the bridleway described in Schedule Part 1 to this notice to create a temporary new path described in Schedule Part 2 of this notice and stop-up the footpaths described in Part 3 to this notice as shown on the Order map.

A copy of the confirmed Order and the Order map may be requested to be sent by email at provconsult@bury.gov.uk and will also be available to view free of charge at the reception desk at Town Hall Bury BL9 0SW from 9:00 to 16:30, Monday to Friday.

This Order comes into force on 25 June 2026 but if any person aggrieved by the Order wants to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Highways Act as amended, or on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to confirmation of the Order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph 8 of Schedule 14 to that Act.

Schedule Part 1 - Temporary Diversion of Bridleway Number 79, Bury - The path runs northwards and then eastwards to (the former site of) Captain's Farm, being enclosed on both sides. Approximately 90m to the east of (the former site of) Captain's Farm the path turns northwards and terminates at Pillsworth Road approximately 180m to the east of Jackson Fold.

Schedule Part 2 - Temporary Alternative Footpath Route - The diversion travels from Restricted Byway Number 85, Bury in a north easterly direction for 1.352km to the Borough Boundary before turning north west for 280m and then west south west for 525m running adjacent to Pillsworth Road. The whole diversion is 2157m in length.

Schedule Part 3 - Temporary Stopping-Up of Footpath 82, Bury - Path starts from Bridleway Number 79, Bury, approximately 137m to the north east of (the former site of) Captain's Farm and eastwards to (the former site of) Hill Top Farm and then to the Borough Boundary.

Part of Footpath No 1, Whitefield - Travels north-eastwards from the district boundary along a private metalled road, fenced both sides. Ends 163m from the Borough Boundary to the east of Moss Hall Road. This part of public footpath becomes part of the temporary alternative route for Bridleway No.79, Bury, described in Schedule 2.
