The Order took effect from 19 June 2026 but any person aggrieved by the confirmed Order who wishes to question its validity on the grounds that it is not within the powers of section 53 of the Wildlife and Countryside Act 1981 or that any of the requirements of Schedule 15 to that Act have not been complied with in relation to the Order may within 42 days from the date of this Notice make an application to the High Court under paragraph 12 of Schedule 15 of the said Act.

DEFINITIVE MAP AND STATEMENT
THE EAST SUSSEX (PUBLIC FOOTPATH
ROTHERFIELD 88) DEFINITIVE MAP MODIFICATION ORDER 2026
Notice is hereby given that the above Order, made on 19 June 2026, if confirmed as made, will modify the Definitive Map and Statement for the area by adding a public footpath as follows:
A route comprised of a public footpath in the civil parish of Rotherfield as detailed below, and as shown on the Order Plan between points A to J;
The public footpath Rotherfield 88 commences at the extent of public highway Town Row Green (C407), at point A, at TQ 5669 3112. From point A the public footpath passes in a generally eastern direction over an existing track for approximately 65 metres, to reach point B, at TQ 5676 3111. From point B the public footpath continues in a south-easterly direction for approximately 30 metres to point C, at TQ 5678 3109.
From point C the public footpath continues in an eastsouth-east direction, partly over an existing track, for approximately 158 metres to point D, at TQ 5692 3102. From point D the public footpath continues in an easterly direction for approximately 262 metres, following the field boundary to point E, at TQ 5718 3099. From point E the public footpath continues in a north-easterly direction for approximately 170 metres to point F, at TQ 5732 3107.
From point F the public footpath continues in an easterly direction for approximately 150 metres to point G, at TQ 5747 3104. From point G the public footpath continues in a north-easterly direction for approximately 200 metres to point H, at TQ 5765 3110. From point H the public footpath continues in an easterly direction for approximately 210 metres, following the field boundary to point I, at TQ 5786 3109.
From point I the public footpath continues in a southeasterly direction for approximately 170 metres over an existing track to the extent of public highway Catts Hill (B2100), at point J, at TQ 5801 3103.
Between point A, TQ 5669 3112, and B, TQ 5676 3111, the public footpath will have an average width of 2.5 metres.
Between point C and TQ 5682 3107 the public footpath will have a width varying between 3 and 3.5 metres.
Between point I, TQ 5786 3109, and J, TQ 5801 3103, the public path will have an average width of 3 metres.
The width of the public footpath will be 1.5 metres over remaining sections.
The total length of public bridleway to be added is approximately 1.4 kilometres.

Copies of the Order and Order Plan can also be viewed at Wealden District Council, between the hours of 9am and 5pm Monday to Friday. Any representation or objection relating to the Order must be sent in writing to Rights of Way, East Sussex County Council, Communities Economy and Transport, West Block, D Floor, County Hall, St Anne’s Crescent, Lewes BN7 1UE or by emailing definitive.map@ eastsussex.gov.uk, quoting reference ‘RWO 243’ not later than 7 August 2026. Applicants are requested to state the grounds on which an objection is made.
If no representations or objections are duly made to the Order, or if any so made are withdrawn, the East Sussex County Council, instead of submitting the Order to the Secretary of State may itself confirm the Order. If the Order is submitted to the Secretary of State for the Environment, Food and Rural Affairs, any representations or objections which have been duly made and not withdrawn will be sent with it.
