(OTHER THAN AN ACQUISITION EXTINGUISHMENT ORDER) SECTION 119 OF THE HIGHWAYS ACT 1980
NORFOLK COUNTY COUNCIL
(BRISLEY FOOTPATH NO.14 (PART) AND BRISLEY FOOTPATH NO. 15 (PART)) DIVERSION ORDER 2023
On 26th March 2026 the Secretary of State for the Environment, Food and Rural Affairs confirmed the above Order made under Section 119 of the Highways Act 1980.
The effect of the Order as confirmed is to divert the full widths of;
Brisley Footpath No. 14
From a line starting at grid reference TF 9534 2021 and running in a generally north easterly direction for approximately 414 metres to grid reference TF 9571 2038.
To a line starting at grid reference TF 9534 2020 and runs in a generally north easterly direction for approximately 368 metres to grid reference TF 9567 2035. The width of the path is 3 metres. Limitations and conditions: none.
Brisley Footpath No. 15
From a line starting at grid reference TF 9567 2036 and running in a generally south easterly direction for approximately 10 metres to grid reference TF 9567 2035.
To a line starting at grid reference TF 9567 2035 and runs in a generally north easterly direction for approximately 44 metres to grid reference TF 9571 2038. The width of the path is 3 metres. Limitations and conditions: none.
A copy of the Order and the Order Map may be seen free of charge at County Hall, Martineau Lane, Norwich, and at the offices of Breckland District Council, Elizabeth House, Walpole Loke, Dereham, Norfolk, NR19 1EE during normal office hours or purchased at a cost of £5.00 from the undersigned or available electronically free of charge from legalordersandregisters@norfolk.gov.uk.
Any person who wishes to claim compensation under section 28 of the 1980 Act for depreciation or damage for disturbance arising as a result of the coming into force of the order must make a claim in writing addressed to the Legal Orders Team Manager at Norfolk County Council at the above County Hall address and serve it by delivering it at, or sending it by prepaid post to, that address not later than 6th August 2026.
The Order comes into force on the date on which Norfolk County Council certify that the terms of Article 1 have been complied with. If a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, make an application to the High Court not later than 6th August 2026.
