PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER

PUBLIC BRIDLEWAY 23, ALDERNEY WATER TREATMENT WORKS DIVERSION ORDER 2026

On 3rd June 2026, BCP Council confirmed the above order made under Section 119 of the Highways Act 1980 and 53A (2) of the Wildlife and Countryside Act 1981.

The effect of the order as confirmed is to divert that length of Public Bridleway 23 (Part) which commences at point A on the order plan (SZ 04311 95141) and leads in a general south easterly direction for 547m and terminates at point B (SZ 04823 94959) on the Mountbatten Roundabout.

An alternative bridleway will be created which commences at point A (SZ 04311 95141) and leads in a generally north northerly direction for a distance of 145m to point C (SZ 04369 95274) and then leads in a north easterly direction for a distance of 120m to point D (SZ 04480 95317) where it connects with Francis Avenue.

A copy of the order as confirmed and the order map have been placed and may be seen free of charge by appointment at BCP Council Civic Centre, Bourne Avenue, Bournemouth, BH2 6DY during normal opening hours. You may also view these on BCP Council’s highway consultation page.

This order comes into force on 30th July 2026, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to this order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 17th June 2026, make an application to the High Court.
