NOTICE OF CIVIL ENFORCEMENT OF MOVING TRAFFIC CONTRAVENTIONS AND PENALTY CHARGES

On the 10 February 2025 the City Council of Bristol (“the Council”) gave notice that pursuant to the Traffic Management Act 2004 (the 2004 Act) and the Civil Enforcement of Moving Traffic Contraventions Designation Order 2023 (which came into force on 22 July 2023), the Council is able to undertake the civil enforcement of moving traffic contraventions within its administrative area.

A moving traffic contravention can be either:
i) an offence under section 36 of the Road Traffic Act 1988 of failing to comply with the indication given by a traffic sign that is subject to civil enforcement; or
ii) an offence of failing to comply with a traffic order (pursuant to the Road Traffic Regulation Act 1984) in so far as it makes provision for a requirement, restriction or prohibition that is conveyed by a traffic sign subject to civil enforcement.

The aim of enforcing moving traffic contraventions is to support the wider transport objectives and to keep traffic moving. In addition to the locations specified in its notice of 10 February 2025, and the locations specified in its notice of 12 January 2026, NOTICE IS HEREBY GIVEN THAT the Council has identified those locations set out in the First Schedule to this Notice where it will also be seeking to enforce moving traffic contraventions.

A moving traffic contravention will attract a Penalty Charge. The Penalty Charges that can apply to moving traffic contraventions are set out in the Second Schedule to this notice.

If the Council determines to enforce the moving traffic contravention, the Penalty Charge shall be set out in a Penalty Charge Notice which shall be served by post.

If payment of the relevant Penalty Charge is made within 21 days of the date of service of the appropriate Penalty Charge Notice, the amount required to be paid is reduced by 50% and the Discounted Penalty Charge specified in the Second Schedule to this Notice shall apply.

If no payment or representation has been received by the Council within 28 days of service of the Penalty Charge Notice, a Charge Certificate may be issued, the effect of which will be to increase the relevant Penalty Charge amount by a further 50% and the Increased Penalty Charge amount specified in the Second Schedule to this Notice shall then apply.

For the purposes of the locations identified in the First Schedule to this Notice, the Penalty Charges specified in the Second Schedule shall come into force on 17 July 2026.

LOCATIONS IDENTIFIED FOR ENFORCEMENT OF MOVING TRAFFIC CONTRAVENTIONS
DUCIE ROAD, LAWRENCE HILL – where motor vehicles (with the exception of solo motorcycles, taxis and permit holders) are prohibited. The contravention of this restriction undermines the objectives of the East Bristol Liveable Neighbourhood; namely, its ability to better manage traffic and provide safe journey routes for pedestrians and active travel, while facilitating access for exempt vehicles and emergency services.
