Wildlife and Countryside Act 1981 - Section 53

The Definitive Map and Statement for the Former Carrick District Area

The Cornwall Council (Addition of a Restricted Byway at Penpol in the Parish of Feock) Modification Order 2026

On 21 May 2026, Cornwall Council confirmed the above order made under section 53(2)(b) of the Wildlife and Countryside Act 1981.

The effect of the order as confirmed is to modify the definitive map and statement for the area by: Adding a length of Restricted Byway in the Parish of Feock commencing at Classified Road C355, 124 metres north-north-east of “Riverside” at Ordnance Survey Grid Reference (OSGR) SW 8130/3912, then running in a south-south-westerly direction for a distance of 148 metres terminating at its junction with Unclassified Road U6069 and Byway Open to All Traffic 29 Feock, 32 metres south-south-east of “Riverside” at OSGR SW 8126/3898.

A copy of the order and order map can be downloaded from Cornwall Council’s website at the following address: https://www.cornwall.gov.uk/environment/ countryside/definitive-map-modification-orders/confirmed-definitive-map-orders/ Copies of the order and map may also be requested by email from PROWOrders@cornwall.gov.uk or by telephoning 0300 1234 202.

A copy of the Order and Map has also been placed and may be seen free of charge at Truro Community Library, Union Place, Truro, TR1 1EP from 09.00 am to 17.00 pm Monday to Friday, and from 10.00 am to 16.00 pm on Saturday.

A copy may also be viewed at the Offices of Cornwall Council at New County Hall, Treyew Road, Truro, TR1 3AY on 9.00 am to 5.00 pm on Monday to Friday (Bank Holidays excepted). The order comes into force on the day that it is confirmed but if any person aggrieved by the order wants to question its validity on the ground that it is not within the powers of Section 53 of the Wildlife and Countryside Act 1981, or on the ground that any requirement of Schedule 15 of the Act has not been complied with in relation to the Order, he or she may under paragraph 12 (1) of Schedule 15 to the Act within six weeks from 4 June 2026, make application to the High Court.
