Public Path Diversion Order 2026

On the 21st May 2026 Blackburn with Darwen Borough Council made the above Order, under Section 119 Highways Act 1980, the effect of which will, if confirmed, divert the public footpath as described in Schedule 1 to this Notice onto the route described in Schedule 2 and shown on the Order Map. In the interests of the public it is expedient that the line of the path be diverted.

A copy of the Order and Map may be examined at the Public Notice Boards outside Blackburn Town Hall and Darwen Town Hall free of charge. Copies of the Order may be purchased at the price of 50p, please make a request to Public.RightofWay@blackburn.gov.uk

Any representations about or objections to the Order together with the grounds on which they are made must be made in writing and sent to the undersigned to be received no later than June 2026. If no such representations or objections are duly made, or if any so made are withdrawn the Blackburn with Darwen Borough Council may confirm the Order as an unopposed Order. If the Order is sent to the Secretary of State for the Environment, Food and Rural Affairs for confirmation any representations and objections which have not been withdrawn will be sent with the Order.

SCHEDULE 1 – LINE OF EXISTING ROUTE

Footpath 62 Tockholes (part)

From the steps and a stile on Tockholes Road at point A (SD 66137 22945) on the attached plan, heading in an easterly direction across fields through a stile at point F (SD 66292 22979), to where it joins the junction of Bridleways 63 and 64 on Weasel Lane Tockholes at the steps at point C (SD 66302 22982).

SCHEDULE 2 – LINE OF DIVERSIONARY ROUTE

From the steps and a gap on Tockholes Road at Point B (SD 66158 22977) in a south easterly direction alongside the fence line of the property Hillside to point C at (SD 66194 22941), the path will then turn in a north easterly direction, staying close to the fence line of the properties Hillside, Rough Lee, Sunnyhurst and The Briers to point D at (SD 66249 22980). The path will then turn again in a south easterly direction to point E at (SD 66264 22968) following the fence line at the rear of the property Fairview on Weasel Lane. From point E at (SD 66264 22968) the path is to remain on its original line through a 1.5m gap at point F (SD 66292 22979) between the properties Fair View and Glenholme to join the junction of Bridleways 63 and 64 Tockholes on Weasel Lane at the steps at point G (SD 66302 22982)
