Notice Of Confirmation Of Public Path Order Highways Act 1980 East Suffolk Council (Benhall Footpath No 26 (Part) And Footpath No 27 (Part)) Public Path Diversion Order 2026

On 21 April 2026 East Suffolk Council confirmed the above order made under Section 119 of the Highways Act 1980.

The effect of the order as confirmed is to divert the entire width of that part of Benhall Public Footpath 26 commencing at Ordnance Survey grid reference (OSGR) TM38106054 and proceeding in a south easterly direction from its junction with Footpath 27 Benhall for a distance of approximately 119 metres to point B at OSGR TM38146043, to a new line running from OSGR TM38086048 approximately 65 metres south from point A at OSGR TM38106054 and proceeding in a generally south easterly direction along a natural surfaced path and then continuing on a boardwalk for a total distance of approximately 78 metres to point B at OSGR TM38146043; and to divert the entire width of that part of Benhall Public Footpath 27 commencing at point D at OSGR TM38076044 and proceeding in a south westerly then westerly direction for a distance of approximately 95 metres to point E at OSGR TM38006040, to a new line running from OSGR TM38076044 and proceeding in a south westerly direction along a natural, enclosed path for a distance of approximately 71 metres to point F at OSGR TM38016041 and continuing in a southerly direction for a distance of approximately 14 metres to point E at OSGR TM38006040 as shown on the order map.

A copy of the order and the order map and explanatory statement have been placed and may be seen free of charge at: Saxmundham Library, Street Farm Road, Saxmundham, IP17 1AL, between the hours of 09:30 and 17:30 Tuesday, 09:30 and 17:30 Wednesday, 09:30 and 17:30 Friday, 10:00 and 13:00 Saturday, and 10:00 and 15:00 Sunday.

The order comes into force on 20 June 2026 but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 8 May 2026 make an application to the High Court.
