What is happening?
SECTION 153 PLANNING ACT 2008
REGULATION 6 OF THE INFRASTRUCTURE PLANNING (CHANGE TO, AND REVOCATION OF, DEVELOPMENT CONSENT ORDERS) REGULATIONS 2011
NOTICE OF APPLICATION TO MAKE A NON-MATERIAL CHANGE TO THE FOLLOWING DEVELOPMENT CONSENT ORDER:
THE M25 JUNCTION 10/A3 WISLEY INTERCHANGE DEVELOPMENT CONSENT ORDER 2022 (SI 2022/549) AS CORRECTED BY THE M25 JUNCTION 10/A3 WISLEY INTERCHANGE DEVELOPMENT CONSENT (CORRECTION) ORDER 2023 (SI 2023/46)
PLANNING INSPECTORATE REFERENCE TR010030
NOTICE IS HEREBY GIVEN that an application has been made by National Highways Limited (company number 09346363) of Three Snowhill, Snow Hill Queensway, Birmingham, England, B4 6GA (“NH”) to the Secretary of State for Transport to make a non-material change to The M25 Junction 10/A3 Wisley Interchange Development Consent Order 2022, as corrected by The M25 Junction 10/A3 Wisley Interchange Development Consent (Correction) Order 2023 (“DCO”), under the Planning Act 2008 (the “NMC Application”).
The DCO prescribes speed limits for various roads within and surrounding the M25 Junction 10/A3 Wisley interchange, effective on or after the date on which the roads are open to traffic. As the works progressed towards the opening of the roads, it became evident that the speed limit provisions prescribed by the DCO conflict with variable speed limits for the M25 carriageway and M25 on-slip roads, prescribed under the M25 Motorway (Junctions 7 to 16) (Variable Speed Limits) Regulations 2012 (SI 2012/2134) (“SI 2012”).
The NMC Application seeks to make a non-material change to the DCO to:
• allow for the imposition of variable speed limits on the M25 carriageway, the two free-flow slip lanes for traffic entering the M25 and the M25 on-slip roads, in accordance with the SI 2012;
• remove a road from the list of roads for which speed limits are prescribed by the DCO in Part 5 of Schedule 3, to reflect a change in the development authorised by the Secretary of State pursuant to Schedule 2, Part 1, Requirement 5 to remove works to that road from the DCO; and
• revise the Speed Limits and Traffic Regulations Plans listed at Schedule 11 to the DCO to refer to an updated version of those plans that reflect the changes sought.
A copy of the NMC Application and its accompanying documents are available for inspection, free of charge, via the Planning Inspectorate’s website, being a website maintained by or on behalf of the Secretary of State, at the below address under the “Documents” tab until at least the end of the consultation period referred to below: https://national-infrastructure-consenting.planninginspectorate.gov.uk/projects/TR010030
