PUBLIC PATH (FOOTPATH NO. 63 - THANE ROAD, BEESTON) DIVERSION ORDER 2026
Broxtowe Borough Council (the Council) gives notice that it has made an Order under section 257 of the TCPA 1990 because it is satisfied that it is necessary to stop up or divert the footpath to which the Order relates to enable the development to be carried out in accordance with the planning permission granted under Part III of the TCPA 1990 to Emily Christie, Ilke Homes Land Ltd by the Council on 09 December 2022 under reference 21/00672/REM.
IF THIS ORDER IS CONFIRMED:
1. The footpath commencing running north to south from Lilac Grove at its junction with Humber Road South for a length of 475 meters shall be diverted as provided by the Order.
2. An alternative footpath shall be created to the reasonable satisfaction of the Council for use as a replacement for the said footpath.
3. A copy of the Order and Plan may be inspected free of charge at the Council Offices at Foster Avenue, Beeston, Nottingham between the hours of 9.00am and 4.30pm Monday to Friday (excluding bank holidays and public holidays) from 02/02/26 to 03/03/2026. A copy may also be viewed on the Council’s Website at www. broxtowe.gov.uk.
4. Any representations about or objections to the Order may be sent or delivered in writing to the Director of Legal and Planning, at the address given below no later than 03 March 2026 being 28 days following the date of this Notice. And should state the grounds on which it is made.
5. If no representations or objections are made, or if made are withdrawn, the Council may confirm the Order as an unopposed Order. If the Order is sent to the Secretary of State for confirmation any representations or objections which have not been withdrawn will be sent with the Order.
6. The stopping up or diversion of the footpath shall have effect on the date on which the Council certifies that the terms of Article 2 of this Notice have been complied with.
