Ar 2ail Rhagfyr 2025, cadarnhaodd Cyngor Sir Fynwy heb addasiadau y Gorchmynion uchod a wnaed o dan Adrannau 26 a 118 o Ddeddf Priffyrdd 1980.
Gorchymyn Creu: Effaith y Gorchymyn oedd creu Llwybr Troed Cyhoeddus newydd 141 Gwehelog Fawr: o bwynt A (SO36791890) i gyfeiriad Gogledd- ddwyreiniol am 311m i bwynt B (SO37011912). Ar led o 2m. Popeth fel y dangosir ar fap y Gorchymyn.
Gorchymyn Diddymu: Effaith y Gorchymyn oedd diddymu llwybrau troed cyhoeddus 84 ac 85 Gwehelog Fawr. Llwybr Troed 84 o Bwynt A (SO34870514) i gyfeiriad De-De-orllewin am 400m i Bwynt C (SO34820482). Llwybr Troed 85 o Bwynt D (SO34710493) i gyfeiriad De-ddwyreiniol am 122m i Bwynt B (SO34800485). Fel y dangosir ar fap y Gorchymyn.

Ar ôl archwiliad ar 17eg Medi 2025, canfu’r Awdurdod fod darpariaethau Rhan 2 a 3 o’r atodlen i’r Gorchymyn yn cydymffurfio gan fod y llwybr troed wedi’i greu a dodrefn wedi’u gosod yn eu lle i foddhad rhesymol yr Awdurdod. Mae’r awdurdod drwy hyn yn ardystio bod creu’r llwybr troed wedi dod i rym o’r dyddiad hwnnw.

Mae copi o’r Gorchmynion fel y’u cadarnhawyd a’r mapiau sydd ynddynt wedi’u gosod a gellir eu harchwilio am ddim yn Hwb Cymunedol Brynbuga, 35 Stryd Maryport, Brynbuga NP15 1AE. Oriau agor: Dydd Llun, Dydd Mercher a Dydd Iau: 9am-5pm, Dydd Sadwrn 9am-12.45pm.

Rhaid i unrhyw berson sy’n dymuno hawlio iawndal o dan Adran 28, fel y’i cymhwysir gan Adran 121(2) o Ddeddf 1980 am ddibrisiant neu ddifrod am aflonyddwch o ganlyniad i’r Gorchymyn yn dod i rym, wneud ei cais yn ysgrifenedig ac wedi’i gyfeirio at y Prif Swyddog – y Gyfraith a Llywodraethiant, Neuadd y Sir, Y Rhadyr, Brynbuga, NP15 1GA a’i gyflwyno trwy ei ddanfon yn, neu ei anfon trwy’r post wedi’i dalu ymlaen llaw i’r cyfeiriad uchod, o fewn chwe mis i’r Gorchymyn ddod i rym.

Daw’r Gorchymyn i rym ar 5ed Rhagfyr 2025. Os yw person sydd wedi’i dramgwyddo gan y Gorchmynion yn dymuno cwestiynu eu dilysrwydd, neu ddilysrwydd unrhyw ddarpariaeth sydd ynddynt, ar y sail nad yw o fewn pwerau Deddf Priffyrdd 1980, fel y’i diwygiwyd, neu ar y sail nad yw unrhyw ofyniad o’r Ddeddf, fel y’i diwygiwyd, neu unrhyw reoliad a wnaed o dan y Ddeddf wedi’i gydymffurfio ag unrhyw ofyniad o’r Ddeddf, fel y’i diwygiwyd, neu o unrhyw reoliad a wnaed o dan y Ddeddf wedi’i gydymffurfio mewn perthynas â’r Gorchymyn, caiff, o dan baragraff 2 o Atodlen 2 i’r Ddeddf fel y’i cymhwysir gan baragraff 5 o Atodlen 6 i’r Ddeddf, o fewn chwe wythnos i ddyddiad yr hysbysiad hwn, wneud cais i’r Uchel Lys.

NOTICE OF CONFIRMATION OF PUBLIC PATH ORDERS MONMOUTHSHIRE COUNTY COUNCIL
CRAFT RENAISSANCE, FOOTPATH 141 GWEHELOG FAWR PUBLIC PATH CREATION ORDER 2025 CRAFT RENAISSANCE FOOTPATHS 84 AND 85 GWEHELOG FAWR PUBLIC PATH EXTINGUISHMENT ORDER 2025

On the 2nd December 2025 Monmouthshire County Council confirmed without modifications the above-named orders made under Sections 26 and 118 of the Highways Act 1980.

Creation Order: The effect of the Order was to create a new Public Footpath 141 Gwehelog Fawr: from point A (SO36791890) in a North Easterly direction for 311m to point B (SO37011912). At a width of 2m. All as shown on the order map

Extinguishment Order: The effect of the order was to extinguish public footpaths 84 and 85 Gwehelog Fawr. Footpath 84 from Point A (SO34870514) in a South South Westerly direction for 400m to Point C (SO34820482). Footpath 85 from Point D (SO34710493) in a South Easterly direction for 122m to Point B (SO34800485). As shown on the order map.

After inspection on 17th September 2025, the Authority found that the provisions of Part 2 and 3 of the schedule to the order had been complied with in that the footpath had been created and furniture put in place to the reasonable satisfaction of the Authority. The authority hereby certifies that the creation of the footpath took effect from that date.

A copy of the Orders as confirmed and the maps contained in them have been placed and may be inspected free of charge at The Usk Commmunity Hub, 35 Maryport St, Usk NP15 1AE. Any person who wishes to claim compensation under S28, as applied by S121(2) of the 1980 Act for depreciation or damage for disturbance in consequence of the coming into operation of the Order must make his claim in writing addressed to the Chief Officer-Law & Governance, County Hall, The Rhadyr, Usk, NP15 1GA and serve it by delivering it at, or sending it by pre-paid post to the above address within six months of the Order coming into effect.

The Order will come into force on the 5th December 2025. If a person aggrieved by the Orders desires to question their validity, or that of any provision contained in them, on the grounds that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from the date of this notice, make an application to the High Court.
