Highways Act 1980 And Wildlife And Countryside Act 1981- (Footpath No 138058 Parish Of Wetheral) - Public Path Diversion And Definitive Map And Statement Modification Order 2024
On the 18th November 2025 Cumberland Council confirmed the above order made under Section 119 of the Highways Act 1980 and Section 53 of the Wildlife and Countryside Act 1981.
The effect of the order as confirmed is to divert the whole width of that length of public footpath no 138058 at Collar Beck in the parish of Wetheral from grid reference 342846 556490 for about B53 metres westwards and north westwards alongside the River Eden then west-north westwards across fields before returning alongside the River Eden, south westwards to grid reference 342119 556741; to run from grid reference 342846 556490 westwards and curving south westwards for about 284 metres bridge, then over bridge tuning northwards for about 132 metres to continue along the bank of the River Eden north-north westwards and south westwards for a further 573 metres to grid reference 342119 556741. The width of the new path will vary from 1.2 metres to 2 metres.

Details of the Order are available to view on the Council's website and copies of the Order may be purchased at a cost of £2 per A4 sheet and £3 per A3 sheet.

The order comes into force on 21st November 2025, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 21st November 2025 make an application to the High Court
