NOTICE OF MODIFICATION ORDERS

HIGHWAYS ACT 1980

SECTION 53 of the WILDLIFE AND COUNTRYSIDE ACT 1981

THE DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY FOR BRACKNELL FOREST BOROUGH

Binfield Bridleway 23A (Mare Lane north) and Binfield Footpath 27 (Mosses Path) Definitive Map Modification Orders 2025

This order, under section 53 (2) is made by Bracknell Forest Council

Notice is hereby given that Bracknell Forest Borough Council made the above Orders on 12 September 2025. As no objections were received, they were confirmed on 24 October 2025 under Section 53 of the Wildlife and Countryside Act 1981 (“the 1981 Act”).

The effect of the Orders as confirmed is to modify the Definitive Map and Statement of Public Rights of Way for the area, by:

  • stopping up of the public bridleway Binfield 23A in its entirety between points A to B, as shown on the plan accompanying the Order, as it appeared to the authority that the highway is not serving a useful function to the public.

  • adding a public footpath to be known as Binfield FP27 between points A and B, running approximately 146 metres, as shown on the plan accompanying the Order.

A copy of the Orders and the Order maps may be seen during office hours at Bracknell Forest Borough Council offices, Time Square, Market Street, Bracknell, RG12 1JD. Copies may be purchased at a cost of £3.00 each. Free digital copies of the Orders may be requested by emailing rights.ofway@bracknell-forest.gov.uk or by telephoning 01344 354441, during office hours.

The Orders became operative from 24 October 2025, but if a person aggrieved by the Orders wants to question their validity, or that of any provision contained in it, on the ground that it is not within the powers of the 1981 Act, or on the ground that any requirement of the Act, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, within 6 weeks from the date this notice was published, under paragraph 12 of Schedule 15 to the 1981 Act make an application to the High Court.
