(SIDE ROADS) ORDER 2023

The Secretary of State for Transport hereby gives notice that on 7 October 2025 she has confirmed the above-named Scheme, as modified by her, and the above-named Order which were made by East Sussex County Council.

1.   The Scheme is made under Section 106(3) of the Highways Act 1980 and as confirmed authorises the Council to construct over the navigable waters of the Cuckmere River a bridge specified in the Schedule to the Scheme as part of the highway they are proposing to construct as a replacement for the Exceat Bridge carrying the A259 Eastbourne Road in the Parish of Cuckmere Valley and the Parish of Sutton with Seaford in the County of East Sussex.

2.   The Order is made under Sections 14 and 125 of the Highways Act 1980 and, as confirmed will authorise the Council to – (i) stop up highways;

(ii)   construct new highways;

(iii) stop up private means of access to premises; and

(iv)  provide new means of access to premises,

All on or in the vicinity of the route of the classified road known as the A259 Eastbourne Road on which the Council is proposing to construct a replacement bridge to carry the A259 Eastbourne Road over the Cuckmere River 22 metres north of the existing Exceat Bridge in the Parishes of Sutton with Seaford and Cuckmere Valley in the County of East Sussex.

A copy of the Bridge Scheme (as confirmed) and the Side Roads Order and of their relevant plans have been deposited, and may be inspected free of charge during normal opening hours at:

The Reception Desk, East Sussex County Council, County Hall, St Annes’s Crescent, Lewes, East Sussex BN7 1UE;

Seaford Library, 15-17 Sutton Park Road, Seaford BN25 1QX; and

Eastbourne Library, Grove Road, Eastbourne BN21 4TL.

In addition, a copy of the Bridge Scheme and the Side Roads Order and their relevant plans have been made available online on the Council’s website at:  https://live.eastsussexhighways.com/highwayschemes/exceat-bridge/3

COPIES of the instrument of confirmation of the Scheme which is entitled “The East Sussex County Council (Exceat Bridge Replacement – A259 Eastbourne Road) Bridge Scheme 2023” and which contains a copy of the relevant Scheme as confirmed, can be obtained at www.legislation.gov. uk or purchased either through booksellers or direct from Government bookshops (The Stationery Office (https://tsoshop.co.uk)).

Any person aggrieved by or desiring to question the validity of the Scheme or Order, or of any provision contained therein, on the grounds that it is not within the powers of the above Highways Act 1980 or that any requirement or regulation made has not been complied with, may, within 6 weeks of 24 October 2025, apply to the High Court for the suspension or quashing of the Scheme or Order or of any provision included.
