Hereford, Experimental Prohibition Of Motor Vehicles During School Restricted Hours

NOTICE OF MAKING HEREFORDSHIRE COUNCIL (VARIOUS TRAFFIC MOVEMENTS) (CONSOLIDATION) ORDER 2022 (EXPERIMENTAL VARIATION) ORDER NO.2 2025 (BARNEY AVENUE (U72430), (CROFT CLOSE (U72431), HEREFORD (PROHIBITION OF MOTOR VEHICLES RESTRICTED HOURS)

NOTICE is hereby given that on 3 November 2025 The County of Herefordshire District Council, known as Herefordshire Council ("the Council") in exercise of its powers under sections 9 and 10 of the Road Traffic Regulation Act 1984 as amended ("the 1984 Act"), Regulation 23 of the Local Authorities' Traffic Orders (Procedure) (England and Wales) Regulations 1996, the Traffic Management Act 2004 ("the 2004 Act") and of all other enabling powers, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the 1984 Act, made the above named Experimental Order the effect of which will be to experimentally vary the Herefordshire Council (Various Traffic Movements) (Consolidation) Order 2022 and in particular map tile references EY72 and EY73 so that:

It is prohibited for any motor vehicle to enter the below lengths of road during the restricted periods of Mon-Fri 8.10-9.10am and 2.50-3.50pm (term times only) except permit holders:

• U72430 Barney Avenue from its junction with U72432 Burdon Drive for a distance of 235m in a westerly direction
• U72431 Croft Close from its junction with U72430 Barney Avenue for its entire adopted length

The reason for the Experimental Order is to prevent motor vehicles entering the restricted areas to create a safer environment for school children to arrive at and depart from school.

This Order will come into operation on 3rd November 2025 and shall continue in force for a period not exceeding 18 months from that date. Within that period, and after the Order has been in operation for not less than 6 months, the Council may decide to make the provisions of this Order permanent or to abandon the experiment and revoke the Order. The Council also reserves the right to abandon the experiment prior to the expiry of the 6-month period. The Experimental Order may be cited as the Herefordshire Council (Various Traffic Movements) (Consolidation) Order 2022 (Experimental Variation) Order No.2 2025 (Barney Avenue (U72430), (Croft Close (U72431), Hereford (Prohibition of Motor Vehicles Restricted Hours).

A copy of the 2022 Order, the Experimental Order named above, a consultation plan, and a Statement of Reasons can be viewed on the Council's website at www.herefordshire.gov.uk/roads and in the Introduced Traffic Regulation Order section, and at Blueschool House Customer Information Centre, Hereford, HR1 2AN. Photocopies of the same may be provided on payment of photocopying charges at the Council.

If any person wishes to question the validity of the Experimental Order or of any of its provisions on the grounds that it is or that they are not within the powers conferred by the 1984 Act, or that any requirement of the Act or any instrument made under the Act has not been complied with, they may apply to the High Court for this purpose.

The Council shall be considering in due course whether the provisions of the Experimental Order should be continued in force indefinitely.

Within a period of six months beginning on the day on which the Experimental Order came into force, or if that Order is varied by another order made pursuant to Section 10 (2) of the 1984 Act, the day on which the variation or modification or the latest variation or modification came into force, any person may object to the making of an order for the purpose of such indefinite continuation.

Any person wishing to object or to make representations in relation to the making of an order for the indefinite continuation of the Experimental Order may within the aforementioned period of six months send a statement in writing of their objection and the grounds thereof to Herefordshire Council, Plough Lane, Hereford, HR4 0LE or via email to SchoolStreets@herefordshire.gov.uk

Any representations received by the Council may be imparted to third parties. We will keep your data for up to 7 years.
