DIVERSION ORDER 2025
On 12th September 2025 Malvern Hills District Council confirmed the above order. The effect of the order as confirmed is to will be to divert that length and the whole width of public footpath no. 561, Pensax, running from point A, Ordnance Survey “OS” grid reference SO 73005 69485, in an easterly direction for 3 metres to point B, grid reference SO 73007 69484, then continuing in a north-easterly direction for 12 metres to point C, grid reference SO 73017 69493, then continuing in a east-north-easterly direction for 5 metres to point D, grid reference SO 73021 69495, then continuing in a south-easterly direction for 12 metres to point E, grid reference SO 73030 69486, to a length of public footpath at a width of 2 metres running from point A, OS grid reference SO 73005 69485, a point at the junction of footpaths 560, 563 and 561, Pensax, running in a south-easterly direction for 19 metres to a pedestrian gate at point F, grid reference SO 73019 69471, then continuing at a width of 2.5 metres in a north-
easterly direction for 14 metres to steps at a width of 1.5 metres at point S, grid reference SO 73027 69483, then continuing at a width of 2 metres in a north-easterly direction for 5 metres to the aforementioned point E, grid reference SO 73030 69486, a point on footpath 561, Pensax, as shown on the order map.
A copy of the order as confirmed may be seen free of charge at The Council House, Avenue Road, Malvern, WR14 3AF between 9.00 am and 3.00 pm on Mondays to Fridays. Copies of the order and map may be obtained there. Copies are also available on the Council’s website at https://www.malvernhills.gov.uk/planning/other-planning-services/footpath-diversions
This order comes into force on the date on which Malvern Hills District Council certify that the terms of Article 2 of the order have been complied with, but if any person aggrieved by the order desires to question its validity or that of any provision contained in it on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to the confirmation of the Order, he or she may apply to the High Court for any of these purposes under s.287 of the Town and Country Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph 7 of Schedule 14 to the Act.
