Notice of Confirmation of a Public Path Diversion and Definitive Map and Statement Modification Order

Dorset Council (Part of Footpath 13, Stoke Abbott at Brimley Mill) Public Path Diversion Order 2025

On 12 September 2025 Dorset Council confirmed the above-named order made under Section 119 of the Highways Act 1980 as unopposed and the Council has certified that work has been carried out to bring the site of the new highway mentioned in article 3 of the order into a fit condition for use by the public.

The effect of the order as confirmed is to divert Footpath 13, Stoke Abbott as shown on the order map as follows:

From the existing path:

The full width of the path from its junction with Footpath 14 and Footpath 37 to the east of Brimley Farm Cottages at ST 4461 0032, generally south east through fields and then through the garden of Brimley Mill and into a field then south east to its junction with Bridleway 12 and the unaffected part of Footpath 13 to the south east of Brimley Mill at ST 4499 0016.

To the new path:

From its junction with Footpath 14 and Restricted Byway 46 at ST 4512 0031 generally south west along the track between Brimley Mill and Higher Farm to ST 4507 0023 then continuing generally south west then west south west along the track to ST 4500 0019, where it enters a field and then runs south west via ST 4500 0018 to its junction with Bridleway 12 at ST 4499 0016.

Width: 2 metres except at ST 4500 0018 and ST 4500 0019 – pedestrian gates to BS5709:2018

A copy of the order and the order map have been placed and may be seen free of charge at Reception, County Hall, Colliton Park, Dorchester during normal office hours. Copies are also available on our website at www.dorsetcouncil.gov.uk/row-orders

The order comes into force 7 days from date of confirmation but if any person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 25 September 2025, make application to the High Court.
