(AS AMENDED) NOTICE OF APPLICATION TO MAKE A NON-MATERIAL CHANGE TO THE FOLLOWING DEVELOPMENT CONSENT ORDER:
THE A122 (LOWER THAMES CROSSING) DEVELOPMENT CONSENT ORDER 2025 (S.I. 2025/462)

NOTICE IS HEREBY GIVEN that National Highways Limited (“National Highways”) of Bridge House, 1 Walnut Tree Close, Guildford, Surrey, GU1 4LZ, is submitting an application (the “NMC-2 Application”) to the Secretary of State for Transport (the “Secretary of State”) under Regulation 4 of the Infrastructure Planning (Changes to, and Revocation of, Development Consent Orders) Regulations 2011 (as amended), for a non-material change to be made to The A122 (Lower Thames Crossing) Development Consent Order 2025 (the “DCO”). The Planning Inspectorate reference number is TR010032.

In March 2025, the Secretary of State made the DCO authorising the construction and operation of the authorised development of the A122 (Lower Thames Crossing). The DCO came into force on 15 April 2025.

Summary of proposals

The NMC-2 Application comprises modification of the wording of Article 65 of the DCO in relation to the requirement for a financial contribution to be made available by National Highways for the benefit of the Kent Downs National Landscape, with the intent of changing the time requirements for agreement to be reached. The proposed amendment would link the timing for reaching agreement of the financial contribution to commencement of works south of the River Thames, instead commencement of works anywhere within the Order limits.

concerned, is available to view electronically and download, free of charge, on the project page of the Planning Inspectorate’s National Infrastructure Planning website, being a website maintained by or on behalf of the Secretary of State, and can be found under the tab “Documents” at: https://national-infrastructure-consenting. planninginspectorate.gov.uk/projects/TR010032

The documents will remain available until at least 23rd October 2025.
