What is happening?

WESTMORLAND AND FURNESS COUNCIL

(VARIOUS ROADS, SOUTH LAKELAND AREA)

(CONSOLIDATION OF TRAFFIC REGULATIONS) (ORDER 2023)

VARIATION NO. 2 20> <

1. Westmorland and Furness Council hereby give notice that it proposes to make the above Order under Sections 1(1) and 2(1) to (4), 32, 35, 35A, 47, 49 and 64 of the Road Traffic Regulation Act 1984.

2. The effect of the proposed Order will be to: -

i) Remove an all vehicles 2 Tonnes Maximum Gross Weight restriction along that part of the U5532 Under Loughrigg Road, Rydal from its junction with the A591 at Pelter Bridge near Rydal via Loughrigg Cottage, Fox and Rosesland to its junction with the A593 at Rothay Bridge;

ii) Remove a 7.5 Tonnes Maximum Gross Weight restriction along that part of Greenside, Kendal from the west side of its junction with Bankfield Road/High Tenterfell, westwards for a distance of 338m;

iii) Remove 7.5 Tonnes Maximum Gross Weight restriction along that part of High Tenterfell/Serpentine Road/Queens Road, Kendal between its junction with Greenside and its junction with Windermere Road;

iv) Amend the restricted length of Mint Close from “Between its junction with Greenside and its junction with Windermere Road” to: “its entire length”;

v) Introduce a 3 Tonnes Maximum Gross Weight restriction along theU5290 Scotch Road Railway Bridge, Lowgill, Firbank for its entire expanse.

vi) Introduce a 7.5 Tonnes Maximum Gross Weight restriction along the following bridges:-

• C5062 Brigsteer Road Bridge, Kendal for its entire expanse;

• C5048 Underbarrow Road Bridge, Kendal for its entire expanse; and

• U5532 Pelter Bridge, Rydal for its entire expanse.

vii) Introduce a 7.5 Tonnes Maximum Gross Weight restriction along the B6254 Kirby Lonsdale from a point immediately south of its junction with the C5106 Hophouse Lane in a southerly direction to its junction with the road that leads to Underley Estate, Kearstwick; and

viii) Introduce a 3 Tonnes Maximum Gross Weight restriction along that part of the U5532 Under Loughrigg Road from its junction with the western leg of the U5532 (the road to Steps End) to its junction with the A593 at Rothay Bridge;

ix) Amend Schedule 98 – Part 1 (Misc) from 5 Tonnes Maximum Gross Weight restriction to 3 Tonnes;

x) Amend Article 137 relating to Schedule 98 to read “Save as provided in 137A of this Order, no person shall cause any motor vehicle, the maximum gross weight of which exceeds 3 tonnes, to proceed along the roads or lengths of roads specified in Schedule 98 of this Order.”

xi) Add Article 137A which will read:-

“Nothing in Article 137 of this Order shall apply to vehicles: -

(a) Being used for Police, Fire Brigade or Ambulance purposes;

(b) Being used for loading/unloading purposes;

(c) Being used in connection with any building operation or demolition in or adjacent to the length of road, the removal of any obstruction to traffic in the length of road, the maintenance, improvement or reconstruction of the length of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line as defined Schedule 2 to the Telecommunications Act, 1984;

(d) Being used to gain access to buildings on the western leg of U5532 (the road to Steps End) which can only be reached from the restricted lengths of road;

(e) in the service of a local authority in pursuance of statutory powers or duties.”

xiii) Add the following exemption to Article 134H to read:

“Nothing in Article 134H of this Order shall apply to: – (c) vehicles proceeding along the U5532 Under Loughrigg Road as specified in SCHEDULE 95E – PART 1 – MISCELLANEOUS to this Order, which are being used to gain access to the western leg of the U5532 (the road to steps end).”

xiv) Add various residential permit parking scheme entitlement adjustments as follows:

89 Appleby Road, Kendal – remove from Zone H, Kendal and add to Mint Street, Kendal;

Rosemede Avenue Nos 23-28 inclusive - to add to Mint Dale, Kendal;

Southwinds, Sunnyside, Kendal - add to Sunnyside, Kendal; and

32-48 (even numbers, inclusive) Appleby Road, Kendal - add to Zone H, Kendal

3. Full details of the proposed Order, together with plans showing the lengths of road concerned, and a statement of the Council’s reasons for proposing to make the Order, may be: -
