North Yorkshire, Modification Order Inquiry For Byway & Bridleway Changes
What is happening?
Notice of Public Local Inquiry.
Wildlife & Countryside Act 1981 Notice is hereby given that Claire Tregembo the Inspector appointed by the Secretary of State for Environment, Food & Rural Affairs to determine North Yorkshire Council (Restricted Byway & Byway Open to All Traffic at Thwaite Lane Clapham-cum-Newby & Austwick) Modification Order 2007 will attend at: County Hall, Northallerton, North Yorkshire, DL7 8AE on 30 Sept 2025 at 10.00am to hold a public inquiry into the Inspector’s proposed modification(s) to the Order as contained in her letter dated 16/10/24. The effect of the Order, if confirmed as made, would be to modify the definitive map & statement for the area by adding to them a restricted byway from Church Avenue at GR SD 7457 6941 proceeding east south east then north north east for approx. 79 metres to the entrance to a tunnel at GR SD 7462 6945, & upgrading on them a bridleway to byway open to all traffic from the entrance to a tunnel at GR SD 7462 6945 proceeding easterly through tunnels for approx. 103 metres continuing easterly for approx. 405 metres to the junction with Long Lane, continuing east south east for approx. 572 metres to Austwick parish boundary at GR SD 7562 6923 proceeding easterly for 368 metres to a cattle creep passing under the road & continuing east for approx. 936 metres to the Y4R road at Crummack Lane at GR SD 7693 6919, continuing from Crummack Lane at GR SD 7694 6919 as byway open to all traffic proceeding east for approx. 443 metres to Staincliffe barn continuing south south east for approx. 147 metres to the C119 Road at GR SD 7746 6909.
The effect of the proposed modifications In Part 1 of the Schedule, Modification of the Definitive Map:
• Under Description of path or way to be added replace all reference to ‘Restricted Byway’ with ‘Bridleway’.
• Replace ‘broken black line with small arrow heads’ with ‘solid line with crossbars’.
• Delete the headings ‘Description of path or way to be upgraded’ & both paths listed under these headings.
In Part 2 of the Schedule, Modification of the Definitive Statement:
• Under Particulars of path or way to be added, Map A (insert) delete ‘RB’ & replace with ‘BW’ & delete ‘Restricted Byway’ & replace with ‘Bridleway’.
• Delete the headings ‘Particulars of path or way to be upgraded Map A’ & ‘Particulars of path or way to be added Map B’ & the paths listed under these headings.
On the Order maps:
• On the ‘key to proposals’ for map A add a symbol for bridleway (solid line with crossbars)
• Add a bridleway line between A & B with name, point & arm the same style between A & B on the inserted from restricted byway to bridleway.
• Delete sections B–C–D–E, E–F–G, & H–J.
