What is happening?

HIGHWAYS ACT 1980 - SECTION 119 NOTICE OF CONFIRMATION OF AN ORDER TEST VALLEY BOROUGH COUNCIL

THE HURSTBOURNE TARRANT FOOTPATH 11 DIVERSION AT IBTHORPE MANOR FARM ORDER 2025

The above Order made under Section 119 of the Highways Act 1980, was confirmed on 19th August 2025 without any objection and now in force, providing a public right of use.

The effect of the order as confirmed is to divert part of the public footpath (Footpath 11 Hurstbourne Tarrant) currently running through the garden of Ibthorpe Manor Farm, Horseshoe Lane, Ibthorpe from point A (grid reference SU 37893 53720) to the East of 'Kinross' for a distance of 50 metres to the Northeast and then for a distance of 70 metres Eastwards marked point B at (grid reference SU 38022 53733) as indicated on the map - the points marked A and B on the order map, and marked with a thick black line will be diverted to alternative route where the public already walk commencing from a point in Horseshoe Lane marked Point A at grid reference SU 37893 53720 to the East of 'Kinross' for a distance of 30 metres to the East and then northwards for a distance of 50 metres marked Point C at grid reference SU 37954 53766 then Eastsoutheast marked Point B at grid SU 38022 53733 for a distance of 55 metres as indicated on the map by the points marked A-C-B and marked with an interrupted thick black line with a width of four (4) metres between point A and C and two (2) metres between C and B as shown on the order map.

A copy of the Order as confirmed and the Order map have been placed and may be seen free of charge during normal office hours from 9:00am to 5:00pm from Monday to Thursday inclusive and from 9:00am to 4:30pm on Fridays at the Council Offices at Beech Hurst, Weyhill Road, Andover SP10 3 AJ. Copies of the Order and map may be bought there at the price of £1. Any person who wishes to claim compensation for depreciation or damage for disturbance arising as a result from the coming into force of the Order is payable under section 28 as applied by section 121(2) of the Highways Act 1980 as amended (by the Transport and Works Act 1992) must make a claim in writing addressed to Katie Nethersole Senior Planning Officer, of Test Valley Borough Council Beech Hurst, Weyhill Road, Andover SP10 3AJ. The Confirmed Order is now in force, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from the date of publication of this notice, make an application to the High Court.
