THE HAMPSHIRE (EAST HAMPSHIRE DISTRICT NO.34) (PARISH OF BINSTED - PART OF BINSTED FOOTPATHS NO.38 AND 44)
PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2025
AND
THE HAMPSHIRE (EAST HAMPSHIRE DISTRICT NO.35) (PARISH OF BINSTED - PART OF FOOTPATH 55) PUBLIC PATH EXTINGUISHMENT AND DEFINITIVE MAP MODIFICATION ORDER 2025
On 07 August 2025 Hampshire County Council confirmed these Orders made under sections 118A and 119A of the Highways Act 1980. The effect of the Order as confirmed is to:
- divert that part of Binsted Footpath 38 which commences at SU 7923 4306 and proceeds in a north-easterly direction along the southern side of Bentley Station platform to a junction with the diverted route of Footpath 44 at SU 7925 4308;
- divert that part of Binsted Footpath 44 which commences at SU 7927 4309 and proceeds in a south-westerly direction to a junction with the diverted route of Footpath 38 at SU 7925 4308, continuing north-westwards across the railway line to SU 7924 4309, then generally westwards through a pedestrian gate and through Bentley Station car park to SU 7919 4308, continuing north-westwards to a junction with Station Road at SU 7918 4309.
- Extinguish that part of Binsted Footpath 55 which commences at a junction with Footpath 44 at SU 7935 4312 and proceeds in a north-easterly direction though an area of woodland, crossing the railway line and continuing through woodland to a junction with Footpaths 38 and 56 at SU 7927 4319. as described in the Schedules to the orders.
A copy of the Order and the Order map have been placed and may be seen free of charge at the offices of Hampshire County Council, The Castle, Winchester, SO23 8UD, and at the offices of East Hampshire District Council, Penns Place, Petersfield, GU31 4EX at all reasonable hours; and online at www.hants.gov.uk/publicnotices. The Order comes into force as from 07 august 2025, but if any person aggrieved by the Order wants to question its validity, or any provision contained in it, on the grounds that it is not within the powers of the Highways Act 1980, as amended, or on the grounds that any requirement of the Act, as amended, or any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 22 August 2025 make an application to the High Court.
