What is happening?

PUBLIC FOOTPATH DIVERSION ORDER 2025

This order is made by Peterborough City Council under section 257 of the Town and Country Planning Act 1990 because it is satisfied that it is necessary to divert the footpath to which this order relates in order to enable development to be carried out in accordance with planning permission granted under Part III of the Town and Country Planning Act 1990 namely: the erection of a pedestrian footbridge across the River Nene under planning reference 24/00644/R3FUL.

BY THIS ORDER:

1. The footpath over the land shown by a bold black line on the attached map and described in Part 1 of the Schedule to this order (“the Schedule”) shall be diverted as provided below.

2. There shall be created to the reasonable satisfaction of Peterborough City Council an alternative highway for use as a replacement for the said footpath as provided in Part 2 of the Schedule and shown by bold black dashes on the attached map.

3. The diversion of the footpath shall have effect on the date on which Peterborough City Council certify that the terms of Article 2 above have been complied with.

4. Where immediately before the date upon which the footpath is stopped up there is apparatus under in over along or across it belonging to Statutory Undertakers for the purpose of carrying out their undertaking, the undertakers shall continue to have the same rights in respect of the apparatus as they then had.

SCHEDULE

PART 1
Description of site of existing footpath (A-F as indicated on the plan)

The whole width of that part of Public Footpath, Peterborough No 5 commencing at Grid Reference TL 1982 9790 (Point A) and running in a generally north-westerly direction for a distance of approximately 306 metres to Grid Reference TL 1955 9804 (Point F).

PART 2
Description of site of alternative footpath (A-B-C-D-E-F as indicated on the plan)

Public Footpath, 2 metres wide commencing at Grid Ref TL 1982 9790 (Point A) and running in a generally southerly direction for a distance of approximately 12 metres to Grid Ref TL 1981 9789 (Point B), then turning and running west south westerly for approximately 119 metres to Grid Ref TL 1970 9791 (Point C) then continuing west south westerly for a further 155 metres to Grid Ref TL 1956 9798 (Point D). From here the footpath turns and runs north westerly for approximately 15 metres to Grid Ref TL 1956 9800 (Point E) before turning and running north-northeasterly then north-north-westerly for a further 46 metres to Grid Ref TL 1955 9804 (Point F).
