Brent, Amendment To Waiting & Loading Restrictions
What is happening?
LONDON BOROUGH OF BRENT
**THE BRENT (WAITING AND LOADING RESTRICTION) (AMENDMENT NO. ) ORDER 202
NOTICE IS HEREBY GIVEN** that the Council of the London Borough of Brent propose to make the abovementioned Order under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and Traffic Management Act 2004.
2. The general effect of the “Waiting and Loading Restriction” Order would be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:
(a) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) would be prohibited at any time in the lengths of streets specified in Schedule 1 to this Notice, except where and when it is permitted in the motorcycle parking areas specified in Schedule 4 to this notice;
(b) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) would be prohibited in the times and in the lengths of streets specified in Schedule 2 to this Notice;
(c) waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 40 minutes in the same place would be prohibited at the times and in the lengths of streets specified in Schedules 1 and 2 to this Notice;
(d) the sale or offer for sale of goods from a vehicle would be prohibited (except on Sundays) in the lengths of streets specified in Schedules 1 and 2 to this Notice, unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is affected;
(e) the use of any vehicle or any animal for the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising would be prohibited in the lengths of streets specified in Schedules 1 and 2 to this Notice;
(f) any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any vehicle or animal for the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in the lengths of streets specified in Schedules 1 and 2 to this Notice would be revoked.
3. The prohibitions referred to in sub-paragraphs 2(a) to (c) inclusive above would not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g. the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Blue Badge” would apply.
4. A copy of the proposed Order, of the relevant Order of 1979 (and of the Orders which have amended that Order), of the Council’s statement of reasons for proposing to make the Order and of maps which indicate each length of road to which the Order relates can be requested via email to trafficorders@brent.gov.uk
or inspected during normal office hours on Mondays to Saturdays inclusive until the end of a period of 6 weeks from the date on which the Order is made or comes into force or, if earlier, the date on which the Council decides not to make the Order at Brent Customer Services, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ.5. 6. Persons desiring to make representations or to object to any of the proposed Order, or to any of the proposals, send a statement in writing of their representations or objections, and the grounds thereof, via email to trafficorders@brent.gov.uk, or in writing to the Head of Healthy Streets and Parking, Healthy Streets and Parking Service, 6th Floor West Wing, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ, quoting the reference TO/02/310/JLJ, to arrive no later than 21 days from the date of publication of this notice.
