What is happening?

NOTICE OF CONFIRMATION OF AN ORDER (OTHER THAN AN ACQUISITION EXTINGUISHMENT ORDER) HIGHWAYS ACT 1980

(FOOTPATH 44 SADDLEWORTH) PUBLIC PATH DIVERSION ORDER 2015

On 24th July 2025 Oldham Borough Council confirmed the above order made under section 119 of the Highways Act 1980.

The effect of the order as confirmed is to divert part of public Footpath 44 Saddleworth running from point A (OS Map Reference 399639 409406) located 15 metres north westerly from the access road to Castleshaw Lower Reservoir then in a north easterly direction to point B (OS Map Reference 399654 409426) at the southern end of Dry Croft Lane to a line running from point C, the pedestrian gate in the masonry wall on Cote Lane (OS Map Reference 399649 409397) located opposite the access road to Castleshaw Lower Reservoir in a north easterly direction for a distance of 14 metres to point D (OS Map Reference 399659 409406) and then north north westerly for a distance of 14 metres to point B (OS Map Reference 399654 409426) at the southern end of Dry Croft Lane as shown on the order map.

A copy of the order as confirmed and the order map have been placed and may be seen free of charge at the Civic Entrance, Civic Centre, West Street, Oldham OL1 1UL from 8.40am and 5.00pm on Mondays to Fridays. Copies of the Order and map may be bought there at the price of £1.

The order comes into force on 22nd August 2025 but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 1st August 2025 make an application to the High Court.
