Notice of Non-Immediate Article 4 Direction Made Under

Article 4(1) of the Town and Country Planning

(General Permitted Development) (England) Order 2015

Wigan Borough Council made the Non-Immediate Article 4 (1) Direction on 15th July 2025, under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (“the Order”).

The Article 4 (1) Direction relates to development consisting of a change of use of a building from a use falling within Class C3 (dwellinghouses) of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) to a use falling within Class C4 (houses in multiple occupation) of that Schedule, being development comprised within Class L of Part 3 of Schedule 2 to the Order within the Borough of Wigan and removes permitted development rights for this type of development from 31st of August 2025, should it be confirmed.

Planning permission will therefore be required for change of use from Class C3 to Class C4 once the Article 4 (1) Direction is in force in the Borough of Wigan.

A copy of the Article 4 (1) Direction and a plan showing the area to which it relates can also be requested and representations made to the local planning authority via emailing Housingdevelopment@wigan.gov.uk between the dates 22nd July 2025 and 12th August 2025.

A49 Wigan Road, Ashton – Prohibition of Waiting and Loading Notice of Proposals

NOTICE IS HEREBY GIVEN that Wigan Borough Council, in exercise of the powers under Section 1, 2, 3 and 4 of the Road Traffic Regulation Act 1984 and the Traffic Management Act 2004 and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the Act 1984, proposes to make the Wigan Borough (Decriminalisation of Parking) (Various Roads in Wigan Borough) (Traffic Regulation Consolidation) Order 2004 (Amendment No.608) Order 2025.

The effect of the Order will be to introduce no waiting at any time on:

•    A49 Wigan Road, Ashton (Southwest side) from a point 15 metres Northwest of its junction with Manse Green Close to a point 15 metres Southeast of its junction with Manse Green Close

There will be limited exceptions permitting vehicles to wait to enable people to board or alight; for the purpose of building and similar operations, removing obstructions to traffic, road works and works by statutory undertakers; for local authority, Water Companies and Post Office purposes; if the vehicles are fire service or police vehicles or ambulances, (liveried vehicles) or in connection with a funeral; to take on fuel, water or air at any garage; for the delivery or collection of goods and for loading or unloading; or the avoidance of an accident.

The effect of the Order will be to introduce no loading at any time on:

•    A49 Wigan Road, Ashton (Southwest side) from a point 15 metres Northwest of its junction with Manse Green Close to a point 15 metres Southeast of its junction with Manse Green Close

The Order also provides that if any vehicle is left in any road or length of road affected by the Order in contravention of any provision of the Order a penalty charge (in the amount set by the Council) shall be payable and/or the vehicle may be removed.

A copy of the proposed Order, the Order to be amended, and of the relevant map and of a statement of the reasons for proposing to make the Order may be requested by emailing s.eccles-churton@wigan.gov.uk.

Any objection to the Order must be made in writing and specify the grounds thereof and must be made to the Assistant Director – Legal, Governance and Elections, Legal, Governance and Elections Division, Wigan Council, Town Hall, Library Street, Wigan WN1 1YN or by emailing the above email address quoting reference RD/LS/ SEC/3526552 not later than 22nd August 2025.

Public Bridleway Wigan No.4 (Part) – Temporary Diversion Notice of Proposals

NOTICE IS HEREBY GIVEN that the Assistant Director Infrastructure and Regulatory

Services of the Wigan Borough Council in exercise of the powers conferred by Section 14 of the Road Traffic Regulation Act 1984 and delegated to her by the said Council, proposes to make the Wigan Borough (Wigan No.4 (Part)) (Temporary Diversion) Order 2025.

The effect of the Order will be to prohibit any person, except upon the direction or with the permission of a police constable, from using:

•  Wigan No. 4 from Point A as shown on the Order Map at grid reference 355035 406468, to Point B at its junction with Wigan Path No. 5 and where the bridleway continues southeast as shown on the Order Map at grid reference 355250 406186 for a distance of approximately 363 metres in a south easterly direction.

An alternative route is available from Point A to Point B as shown on the Order Map via Walthew House Lane and the public rights of way network; Wigan Paths No. 3 and 5, a distance of approximately 642 metres.

The public bridleway will be closed for a period of three months commencing on 30th July 2025.

The Order is necessary to safeguard the public, whilst a high voltage electricity cable is installed.

(Prescott Street, Wigan) (Temporary Closure) Order 2025 Notice of Proposals

NOTICE IS HEREBY GIVEN that the Assistant Director Infrastructure and Regulatory Services of the Wigan Borough Council in exercise of the powers conferred by Section 14 of the Road Traffic Regulation Act 1984 and delegated to her by the said Council proposes to make the Wigan Borough (Prescott Street, Wigan) (Temporary Closure) Order 2025.

The effect of the Order will be to prohibit any person from driving a vehicle or causing or permitting a vehicle to be driven in Prescott Street, Wigan at the railway bridge commencing on 14th September 2025 between the hours of 09:00 and 15:00 only.

The alternative route for traffic is: Frog Lane, New Market Street, Northway, Riverway, Chapel Lane, Caroline Street and Wallgate.

The Order is necessary to allow access and assessment of the bridge.

(Moss Avenue, Billinge) (Temporary Closure) Order 2025

Notice of Proposals

NOTICE IS HEREBY GIVEN that the Assistant Director Infrastructure and Regulatory Services of the Wigan Borough Council in exercise of the powers conferred by Section 14 of the Road Traffic Regulation Act 1984 and delegated to her by the said Council proposes to make the Wigan Borough (Moss Avenue, Billinge) (Temporary Closure) Order 2025.

The effect of the Order will be to prohibit any person from driving a vehicle or causing or permitting a vehicle to be driven in Moss Avenue, Billinge commencing on 3rd November 2025 to 7th November 2025.

Please note, access will be maintained where possible.

The Order is necessary to allow a new electric connection.
