Mid Devon (Off-Street Parking Places Order 2016)
Amendment No 2 (the “Order”)
Mid Devon District Council under Sections 32, 35 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 the Traffic Management Act 2004 and all other enabling legislation has made the Order with the consent of Devon County Council.
The Order amends the existing Mid Devon (Off-Street Parking Places Order 2016) (as amended) hereinafter referred to in this notice as the “Existing Order”.
The effect of the Order is:-
(a) To update the references to legislative regulations in the Existing Order to the new Civil Enforcement of Road Traffic Contraventions (Approved Devices, Charging Guidelines and General Provisions) (England) Regulations 2022.
(b) To include a new Car Park known as the Orchard at Halberton, Devon to be subject to the articles of the Existing Order and to allow permit parking only at the Orchard Car Park.
(c) To provide in the Existing Order that no person shall park in an Electric Vehicle Parking Bay unless the Vehicle is an Electric Vehicle in the process of being charged at an Electric Charging Point.
(d) To provide in the Existing Order that payment of parking charges can be made by Electronic Payment.
(e) To update the Existing Order.
The Order will come into force on 6 May 2025

The Order may be examined at the Council’s offices at Phoenix House, Phoenix Lane, Tiverton, Devon EX16 6PP during the Council’s normal office hours.
Application to the High Court:-
If any person wishes to question the validity of the Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or of any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court.
