Dorset Council (Footpath 94 (part) & Footpath 106, Thorncombe at Gashay Farm and Footpath 65 (part), Marshwood) Public Path Diversion Order 2021
On 14 March 2025 Dorset Council confirmed the above-named order made under Section 26 of the Highways Act 1980 as unopposed and the Council has certified that work has been carried out to bring the site of the new highway mentioned in article 3 of the order into a fit condition for use by the public.
The effect of the order as confirmed is to divert footpaths in the parishes of Thorncombe and Marshwood as shown on the order map as follows:
From the existing paths:
Part of Footpath 94, Thorncombe:
Part of the Wessex Ridgeway and Liberty Trail
The full width of the footpath from the unaffected part of Footpath 94 at ST 37580061, generally north east, passing through a vegetable garden and farm buildings then continuing across fields to rejoin the unaffected part of Footpath 94, on the southern edge of woodland at ST 37810075. (No recorded width).
Footpath 106, Thorncombe:
The full width of the footpath from ST 37600064, generally east south east across fi elds to its junction with Footpath 65, Marshwood at the Marshwood parish boundary at ST 37770056. (No recorded width).
Part of Footpath 65, Marshwood:
From the unaffected part of Footpath 65 at ST 37930026, generally north north west across a field its junction with Footpath 106, Thorncombe at the Thorncombe parish boundary at ST 37770056. (No recorded width).
To the new paths:
Part of Footpath 94, Thorncombe:
Part of the Wessex Ridgeway and Liberty Trail
From the unaffected part of Footpath 94 at ST 37580061, south east across a field to ST 37640056, then generally north north east following the fi eld boundary to ST 37660059, then east, crossing into the next fi eld to its junction with the proposed new route of Footpath 106 at ST 37660058. Continuing north north east along the western fi eld boundary and along a farm track to ST 37770076, then east south east along the track to rejoin the unaffected part of Footpath 94, on the southern edge of woodland at ST 37810075. Width: 2 metres except for 1.2 metres at ST 37810075 and ST 37660058. Limitations: Pedestrian gates at ST 37810075 and ST 37660058 to BS5709:2018.
Footpath 106, Thorncombe:
From its junction with the proposed new route of Footpath 94 at ST 37660058, south south west along the western field boundary to ST 37660057 and generally east to ST 37726 00565, then south to its junction with the proposed new route of Footpath 65, Marshwood at the Marshwood parish boundary at ST 37727 00561.
Part of Footpath 65, Marshwood:
From the unaffected part of Footpath 65 at ST 37930026, generally north west across a field to the fi eld boundary at ST 37728 00557 and continuing north to its junction with the proposed new route of Footpath 106, Thorncombe at the Thorncombe parish boundary at ST 37727 00561. Width: 2 metres except for 1.2 metres at ST 37728 00557. Limitation: Pedestrian gate at ST 37728 00557 to BS5709:2018.
A copy of the order as confirmed and the order map have been placed and may be seen free of charge at Reception, County Hall, Colliton Park, Dorchester during normal office hours.

The order comes into force on 21 March 2025 but if any person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 1 May 2025, make an application to the High Court.

The effect of the order as confirmed is to create a public footpath in Thorncombe at Gashay Farm as shown on the order map as follows:
From its junction with the proposed new route of Footpath 94, Thorncombe at ST 37580061, north east along a grass/earth surfaced track to its junction with Gashay Lane (D10118) at ST 37620066. Width: 2 metres.
