What is happening?

 

Notice of extension of an Order temporarily closing Public Footpath EE174 in the Parish of Wingham

In The District of Dover

(Prohibition Of Traffic) Temporary Order 2024

Road Traffic Regulation Act 1984 Section 14(1), As Amended By The Road Traffic (Temporary Restrictions) Act 1991

The Secretary of State for Transport has directed that the Order made by Kent County Council on the 11 November 2024, the effect of which was to prohibit all traffic from Public Footpath EE174 has been extended for a further 15 months, until the 11 August 2026 or until the completion of the works, whichever is the earlier

The path is closed between Miller Close and Staple Road

The alternative route is via Miller Close and the southern boundary of the field by Staple Road, and will be signed for the duration of the closure.

NOTICE OF MODIFICATION ORDER

WILDLIFE AND COUNTRYSIDE ACT 1981

DEFINITIVE MAP AND STATEMENT FOR THE COUNTY OF KENT

THE KENT COUNTY COUNCIL
(PUBLIC FOOTPATH TMX45, MARGATE)
DEFINITIVE MAP MODIFICATION ORDER 2025

The above Order was made on the 5th March 2025 under section 53 of the Wildlife and Countryside Act 1981. If confirmed, it will modify the Definitive Map and Statement for the area by adding a public footpath numbered TMX45 which commences at its connection with High Street at NGR TR 35270 70969 (Point A) and runs in an east-by-south direction for 21 metres to NGR TR 35291 70966 (Point B), and then runs in a southerly direction for 3 metres before running in an eastern direction for 1 metre to NGR TR 35291 70962 (Point C) where the path terminates at the Market Street Car Park. The path will have a recorded width of 2.2 metres between Points A and B, and a width of 1.95 metres between Points B and C. The path terminates at a 1.0 metre wide gap at Point C.

Any representation about or objection to the Order must be sent or delivered in writing to William Barfoot at the Kent County Council (PROW & Access Service, Invicta House, County Hall, Maidstone, Kent, ME14 1XX, William.Barfoot@kent.gov.uk) no later than 13th June 2025. Please state the grounds on which they are made.

Please note that objections/representations cannot be treated as confidential and may come into the public domain. Copies of any objections or representations received may be disclosed to interested parties, including the Planning Inspectorate where the case is referred to it for determination.

If no such representations or objections are duly made to the Order (or to any part of it), or if any so made are withdrawn, the Kent County Council, instead of submitting the Order to the Secretary of State (or part of it if the Authority has by Notice to the Secretary of State so elected under paragraph 5 of schedule 15 to the Wildlife and Countryside Act 1981) may itself confirm the Order (or that part of the Order). If the Order is sent to the Secretary of State for the Environment (in whole or in part), any representations or objections which have been duly made and not been withdrawn will be sent with it.

In The Borough of Tonbridge & Malling

(Public Footpath MR100) (Prohibition Of Traffic) Temporary Order 2024

Road Traffic Regulation Act 1984 Section 14(1), As Amended By The Road Traffic (Temporary Restrictions) Act 1991

The Secretary of State for Transport has directed that the Order made by Kent County Council on the 04 November 2024, the effect of which was to prohibit all traffic from Public Footpath MR100 has been extended for a further 12 months, until the 04 May 2026 or until the completion of the works, whichever is the earlier

The path is closed between Brampton Field and TQ707576

The alternative route is via a constructed tarmac path to the north west and will be signed for the duration of the closure.

IN THE BOROUGH OFTONBRIDGE & MALLING

NOTICE OF CONFIRMATION OF MODIFICATION ORDER

WILDLIFE AND COUNTRYSIDE ACT 1981

DEFINITIVE MAP AND STATEMENT FOR THE COUNTY OF KENT

THE KENT COUNTY COUNCIL
(PUBLIC FOOTPATH MR623 AT DITTON)
DEFINITIVE MAP MODIFICATION ORDER 2023

On 19 March 2025 an Inspector appointed by the Secretary of State for Environment, Food and Rural Affairs confirmed the above Order without modifications.

The effect of the Order as confirmed is to modify the Definitive Map and Statement for the area by adding a public footpath numbered MR623, which commences at its junction with New Road at NGR TQ 7120 5830 (Point A on the Order plan) and runs in a north westerly then north north-easterly direction for 70 metres to its connection with the Ditton Recreation Ground at NGR TQ 7115 5834 (Point B on the Order plan). The path has a width of 3.7 metres for a distance of 9.5 metres from Point A to Point A1 (NGR TQ 7120 5830), a width of 3.4 metres for a distance of 30 metres from Point A1 to Point A2 (NGR TQ 7117 5832), a width of 4.1 metres for a distance of 7.5 metres from Point A2 to Point A3 (NGR TQ 7116 5832), a width of 3.2 metres for a distance of 12 metres from Point A3 to Point A4 (NGR TQ 7115 5833), a width of 2.6 metres for a distance of 5.5 metres from Point A4 to Point A5 (NGR TQ 7115 5833) and a width of 1.9 metres for a distance of 5.5 metres from Point A5 to Point B.

This Order became operative as from 19 March 2025 but if a person aggrieved by the Order desires to question the validity thereof or of any provision contained therein on the grounds that it is not within the powers of Section 53(3)(c)(i) of the Wildlife and Countryside Act 1981, or that any of the requirements of Schedule 15 to the Act have not been complied with in relation to the confirmation of the Order, they may, under Paragraph 12 of Schedule 15 to the Act, within 42 days from 02 May 2025 make application for the purpose to the High Court.
