GORCHYMYN CAU PRIFFYRDD (LLWYBR TROED O FEWN GWAITH SMENT PADESWOOD, CHESTER ROAD, YR WYDDGRUG, SIR Y FFLINT) 2025

Mae Gweinidogion Cymru wedi gwneud Gorchymyn o dan adran 247 o Ddeddf Cynllunio Gwlad a Thref 1990 ("Deddf 1990") i awdurdodi cau darn o briffordd a ddisgrifir yn Atodlen 1 i’r Hysbysiad hwn a ddangosir ar y cerbydwr clwm â’r Gorchymyn fel y’i hysbysebir. Nid yw awdurdodi’r cau’r briffordd o dan y ffurf y mae’r Gorchymyn yn ei chael ar hyn o bryd yn cael ei roi oni bai fod ar ran 3 o Ddeddf 1990 gan Weinidogion Cymru ar 4/4/2025 o dan y cyfeirnod DNS-CAS-02009-W1R127 a ddisgrifir yn Atodlen 3 i’r Hysbysiad hwn.

Bydd Gorchymyn Cau Priffyrdd (Llwybr Troed o fewn Gwaith Sment Padeswood, Chester Road, yr Wyddgrug, Sir y Fflint) 2025 (“y Gorchymyn”), os caiff ei wneud, yn peidio â chael effaith os daw’r caniatâd cynllunio mewn cysylltiad â’r datblygiad i ben neu os caiff ei diddymu.

Town and Country Planning Act 1990 (As Amended)

THE STOPPING UP OF HIGHWAYS (FOOTPATH WITHIN PADESWOOD CEMENT WORKS, CHESTER ROAD, MOLD, FLINTSHIRE) ORDER 2025

The Welsh Ministers have made an Order under section 247 of the Town and Country Planning Act 1990 (“the 1990 Act”) to authorise the stopping up of the lengths of highway described in Schedule 1 to this Notice and to provide for the lengths of new highway described in Schedule 2 to this Notice. The stopping up will be authorised only in order to enable the development to be carried out in accordance with planning permission granted under Part 3 of the 1990 Act on 4/4/2025 with reference number DNS CAS-02009-W1R127, as described in Schedule 3.

The Stopping Up of Highways (Footpath within Padeswood Cement Works, Chester Road, Mold, Flintshire) Order 2025 (“the Order”), will cease to have effect if planning permission in respect of the development expires or is revoked.

If a person is aggrieved by the Order, on the grounds that:

a. it is not within the powers of the 1990 Act; or

b. a procedural requirement of the 1990 Act has not been complied with;

that person may, within 6 weeks of 04/04/2025 make an application for the Order to be quashed in the High Court.

A length of footpath that is located to the south of Padeswood Cement Works, known as PROW 301/56/20 in Mold, Flintshire, with a maximum length of 437.7 metres and a maximum width of 2 metres, which extends from points A to B as shown on the deposited plans.

A length of footpath located to the south of Padeswood Cement Works, Chester Road, Mold Flintshire with a maximum length of 385.3 metres and a minimum width of 2 metres, extending from points D to C shown on the deposited plans.

The erection of a post combustion carbon capture plant, together with a combined heat and power plant and other associated plant and structures at Padeswood Cement Works, Chester Road, Mold, Flintshire.
