HYSBYSIR gyda hyn fod Cyngor Bwrdeistref Sirol Merthyr Tudful, yn arfer ei bwerau o dan Adrannau 1(1) a 2(1) i (3) o Ddeddf Rheoleiddio Traffig Ffyrdd 1984 (“y Ddeddf”)(fel y’i diwygiwyd), a phob pŵer galluogol arall ac ar ôl ymgynghoriad â Phennaeth yr Heddlu yn unol â Rhan III o Atodlen 9 y Ddeddf yn bwriadu gwneud y Gorchymyn a ganlyn. Disgrifir ei effaith gyffredinol, isod. Mae effaith y Gorchymyn fel a ganlyn: -

1. Ni chaiff yr un person beri i unrhyw gerbyd aros rhwng 8:00am a 6:00pm ar hyd ac ar ochrau darnau’r ffordd a bennir yn Atodlen 1.

2. Ni chaiff unrhyw berson beri i unrhyw gerbyd lwytho neu ddadlwytho rhwng 8:00 am a 6:00 pm ar hyd ac ar ochrau darnau’r ffordd a bennir yn Atodlen 2.

3. Ni chaiff yr un person beri i unrhyw gerbyd stopio nac aros ac eithrio tacsis rhwng 11:00pm a 4:00am ar hyd ac ar ochrau darnau’r ffyrdd a bennir yn Atodlen 3.

4. Ni chaiff yr un person beri i unrhyw gerbyd stopio nac aros ar unrhyw adeg ac eithrio tacsis rhwng 6:00 pm a 8:00 am ar hyd ac ar ochrau darnau’r ffyrdd a bennir yn Atodlen 4.

5. Amrywio’r Gorchmynion a bennir yn Atodlen 5.

6. Ni fydd unrhyw beth yn Erthyglau 1 a 2 yn ei gwneud hi’n anghyfreithlon i gerbydau’r gwasanaethau brys aros ar hyd ac ar ochrau darnau’r ffyrdd a bennir. Caniateir i gerbydau aros at ddibenion adeiladu a gwaith ffordd, ar gyfer cynnal a chadw, gwella, ailadeiladu, arolygu neu arolygu hyd y ffyrdd ac ochrau darnau o ffyrdd a chynnal a chadw gwasanaethau hanfodol. Caniateir i gerbydau aros at ddibenion esgyn, disgyn, priodasau, angladdau a dosbarthu pecynnau post gan gerbydau gwasanaeth Swyddfa’r Post. 

7. Ni fydd unrhyw beth yn Erthygl 1 yn ei gwneud hi’n anghyfreithlon i gerbydau aros ar hyd ac ar ochrau darnau’r ffyrdd a bennir at ddibenion llwytho a dadlwytho.

8. Ni chaiff unrhyw beth yn Erthygl 1 ei gwneud hi’n anghyfreithlon i gerbydau pobl anabl sy’n arddangos y bathodyn perthnasol i bobl anabl aros am hyd at dair awr (gyda dychwelyd wedi’i wahardd o fewn awr) ar hyd ac ar ochrau darnau’r ffyrdd a nodir. 

9. Ni fydd unrhyw beth yn Erthyglau 3 a 4 yn gymwys: -
(i) i unrhyw beth a wneir gyda chaniatâd neu ar gyfarwyddyd Swyddog yr Heddlu mewn iwnifform. 

(ii) i gerbyd sy’n cael ei ddefnyddio at ddibenion ambiwlans, tân neu heddlu mewn perthynas ag argyfwng neu wrth fynd ar drywydd dyletswyddau neu ddibenion heddlu os byddai cadw’r ddarpariaeth honno yn debygol o rwystro defnyddio’r cerbyd hwnnw at y diben y mae’n cael ei ddefnyddio ar yr achlysur hwnnw.

10. Ni fydd unrhyw beth yn Erthyglau 3 a 4 yn ei gwneud hi’n anghyfreithlon achosi neu ganiatáu i gerbyd aros mewn ffordd gyfyngedig cyhyd ag y bo’n angenrheidiol i alluogi’r cerbyd 
a)os na ellir ei defnyddio’n gyfleus at ddibenion o’r fath mewn ffordd arall i’w defnyddio mewn cysylltiad â
i) chael gwared ar unrhyw rwystr i draffig
ii) cynnal a chadw, ailadeiladu neu wella hyd ffordd
iii) gosod, codi, newid neu atgyweirio mewn neu ger unrhyw un o ddarnau’r ffordd o bibell garthffosiaeth, prif bibell neu gyfarpar ar gyfer cyflenwi nwy, dŵr, trydan neu gyfarpar telathrebu fel y’u diffinnir yn atodlen 2 i Ddeddf Telathrebu 1984
b)os na ellir ei defnyddio’n gyfleus mewn ffordd arall i’w defnyddio yng ngwasanaeth awdurdod lleol neu awdurdod dŵr yn unol â phwerau neu ddyletswyddau statudol
c) i’w ddefnyddio at y diben a awdurdodwyd gan ac a ddisgrifir ar ddosbarthiad neu drwydded a gyhoeddwyd gan yr awdurdod cyhoeddi ar yr amod bod y dosbarthiad neu’r drwydded o’r fath yn amlwg trwy sgrin wynt y cerbyd ar y dangosfwrdd.
11. Er mwyn osgoi amheuaeth, ni chaniateir i gerbyd pobl anabl aros na stopio ar unrhyw ddarn o ffordd y cyfeirir ato yn erthyglau 3 a 4.
12. Gellir gweld dogfennau sy’n rhoi manylion pellach am y Gorchymyn yng Nghyngor Bwrdeistref Sirol Merthyr Tudful, Uned 5, Parc Busnes Triongl, Pentrebach, Merthyr Tudful, CF48 4TQ. 
13. Rhaid gwneud gwrthwynebiadau i’r Gorchymyn ynghyd â’r sail y maent yn cael eu gwneud yn ysgrifenedig i’r isod erbyn 25 Ebrill 2025.

ATODLEN 1
GWAHARDD AROS 8:00 AM - 6:00 PM
1. Ochr dde-orllewinol Maes y Clastir o bwynt 10 metr i’r gogleddorllewin o’r gyffordd â Stryd y Castell am bellter o 83 metr i gyfeiriad y gogledd-orllewin.
2. Ochr ogledd-ddwyreiniol Maes y Clastir o bwynt 75 metr i’r gogleddorllewin o’r gyffordd â Stryd y Castell am bellter o 18 metr i gyfeiriad y gogledd-orllewin.

ATODLEN 2
GWAHARDD LLWYTHO A DADLWYTHO 8:00 AM - 6:00 PM
1. Ochr dde-orllewinol Maes y Clastir o bwynt 10 metr i’r gogleddorllewin o’r gyffordd â Stryd y Castell am bellter o 83 metr i gyfeiriad y gogledd-orllewin.
2. Ochr ogledd-ddwyreiniol Maes y Clastir o bwynt 75 metr i’r gogleddorllewin o’r gyffordd â Stryd y Castell am bellter o 18 metr i gyfeiriad y gogledd-orllewin.

Ochr ogledd-ddwyreiniol Maes y Clastir o bwynt 10 metr i’r gogleddorllewin o’r gyffordd â Stryd y Castell am bellter o 65 metr i gyfeiriad y gogledd-orllewin.

GLEBELAND PLACE AND A4054 COLLEGE BOULEVARD, MERTHYR TYDFIL
(PROHIBITION OF WAITING) (PROHIBITION OF LOADING AND UNLOADING) (PROHIBITION OF STOPPING EXCEPT TAXIS) (PROHIBITION OF STOPPING AT ANY TIME EXCEPT TAXIS) (VARIATION) ORDER 2025

NOTICE is hereby given that Merthyr Tydfil County Borough Council in exercise of its powers under Sections 1(1) and 2(1) to (3) of the Road Traffic Regulation Act 1984 (“the Act”)(as amended), and all other enabling powers and after consultation with the Chief of Police in accordance with Part III of Schedule 9 of the Act proposes to make the following Order, the general effect of which is described below. The effect of the Order is as follows: -

1. No person shall cause any vehicle to wait 8:00 am - 6:00 pm on the lengths and sides of lengths of road specified in Schedule 1.

2. No person shall cause any vehicle to load or unload 8:00 am - 6:00 pm on the lengths and sides of lengths of road specified in Schedule 2.

3. No person shall cause any vehicle to stop or remain at rest other than taxis 11:00 pm – 4:00 am on the lengths and sides of lengths of roads specified in Schedule 3.

4. No person shall cause any vehicle to stop or remain at rest at any time other than taxis 6:00 pm – 8:00 am on the lengths and sides of lengths of roads specified in Schedule 4.

5.Vary the Orders specified in Schedule 5.

6. Nothing in Articles 1 and 2 shall render it unlawful for emergency service vehicles to wait on the lengths of roads and sides of lengths of roads specified ‘therein’. Vehicles are allowed to wait for the purposes of building and roadworks, for maintenance, improvement, reconstruction, inspection or survey of the lengths of roads and sides of lengths of roads and the maintenance of essential services. Vehicles are allowed to wait for the purposes of boarding, alighting, weddings, funerals and the delivery of postal packets by vehicles of the service of the Post Office. 

7. Nothing in Article 1 shall render it unlawful for vehicles to wait on the lengths of roads and sides of lengths of roads specified ‘therein’ for the purposes of loading and unloading.

8. Nothing in Article 1 shall render it unlawful for disabled persons’ vehicles displaying the relevant disabled persons badge to wait for up to three hours (with a return prohibited within one hour) on the lengths of roads and sides of lengths of roads specified ‘therein’. 

9. Nothing in Articles 3 and 4 shall apply: -
(i) to anything done with the permission or at the direction of a Police Officer in Uniform. 
(ii) to a vehicle being used for ambulance, fire or police purposes in relation to an emergency or whilst in pursuit of duties or police purposes if the observance of that provision would be likely to hinder the use of that vehicle for the purpose for which it is being used on that occasion.

10. Nothing in Articles 3 and 4 shall make it unlawful to cause or permit a vehicle to wait in a restricted road for so long as may be necessary to enable the vehicle 
a) if it cannot conveniently be used for such purposes in another road to be used in connection with
i) the removal of any obstruction to traffic
ii) the maintenance, reconstruction or improvement to the length of road
iii) the laying, erection, alteration or repair in or near any of the lengths of road of a sewer, main pipe or apparatus for the supply of gas, water, electricity or telecommunications apparatus as defined in schedule 2 of the Telecommunications Act 1984
b) if it cannot conveniently be used in another road to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties
c) to be used for the purpose authorised by and described on a dispensation or permit issued by the issuing authority provided such dispensation or permit is clearly visible through the windscreen of the vehicle on the dashboard.

11.For the avoidance of doubt a disabled persons’ vehicle is not permitted to wait or stop in any length of road referred to in articles 3 and 4.

12.Documents giving more detailed particulars of the Order can be viewed at Merthyr Tydfil County Borough Council, Unit 5, Triangle Business Park, Pentrebach, Merthyr Tydfil, CF48 4TQ. 

13.Objections to the Order together with the grounds on which they are made must be made in writing to the undersigned by 25th April 2025.

SCHEDULE 1
PROHIBITION OF WAITING 8:00 AM - 6:00 PM
1. The south-western side of Glebeland Place from a point 10 metres north-west of its junction with Castle Street for a distance of 83 metres in a north-westerly direction.

2. The north-eastern side of Glebeland Place from a point 75 metres north-west of its junction with Castle Street for a distance of 18 metres in a north-westerly direction.

SCHEDULE 2
PROHIBITION OF LOADING AND UNLOADING 8:00 AM - 6:00 PM
1. The south-western side of Glebeland Place from a point 10 metres north-west of its junction with Castle Street for a distance of 83 metres in a north-westerly direction.

2. The north-eastern side of Glebeland Place from a point 75 metres north-west of its junction with Castle Street for a distance of 18 metres in a north-westerly direction.

SCHEDULE 3
PROHIBITION OF STOPPING EXCEPT TAXIS 11:00 PM – 4:00 AM
That part of the lay by on the western side of the northern end of A4054 College Boulevard from the southern end of the lay by for a distance of 58 metres in a northerly direction.

SCHEDULE 4
PROHIBITION OF STOPPING AT ANY TIME EXCEPT TAXIS 6:00 PM – 8:00 AM 
The north-eastern side of Glebeland Place from a point 10 metres northwest of its junction with Castle Street for a distance of 65 metres in a north-westerly direction.

SCHEDULE 5
VARIATION OF EXISTING ORDERS
Vary the “Merthyr Tydfil County Borough Council Glebeland Place, Town Centre, Merthyr Tydfil (Prohibition of Waiting) (Prohibition of Loading/ Unloading) (Disabled Parking) (Variation) Order 2019” by the deletion of Schedule 1 item 1 and Schedule 2 item 1.
