Whitehaven, Consolidation & Revision Of Waiting, Parking & Loading Restrictions

What is happening?

CUMBERLAND COUNCIL (VARIOUS ROADS, WHITEHAVEN) (CONSOLIDATION AND PROVISION OF TRAFFIC REGULATIONS) ORDER 2025

  1. Cumberland Council hereby gives notice that on 25 March 2025 it made the above Order under Sections 1(1), 2(1) to (4), 19, 32, 35, 38, 45, 46, 47, 49, 51, 53 and 54 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 and Part 6 of the Traffic Management Act 2004.

  2. The Order will come into operation on 3 April 2025 and its effect will be to consolidate the provisions of The County of Cumbria (Various Roads, Whitehaven) (Consolidation and Provision of Traffic Regulations) Order 2019 and introduce/revoke (as applicable) the following restrictions in Whitehaven and surrounding area:

(a) “No Waiting At Any Time” restrictions on part(s) of the following roads:

i) Bedford Street, Braggy Terrace, Calder Avenue, Countess Road, Earl’s Road, High Road, James Pit Road, Lonsdale Street, Monkwray Brow, New Road, Park Drive, Red Lonning (Whitehaven Golf Club entrance), Rutland Avenue, South Row, Snebrayer Grove, St George’s Road, Solway View, The Gardens, West Avenue, and Whitehaven School entrance.

ii) Station Approach, Victoria Place Whitehaven; together with the removal of the “No Waiting At Any Time” restrictions on parts of Albion Street, Queen Street and Scotch Street.

(b) Extend the Disabled Parking Place (with “Permit Holders Only” to individual) on part of James Pit Road, Whitehaven.

(c) 3 new/modernise “Disc Parking Places, Waiting Limited to 1 Hour, return prohibited within 1 hour, between 8.30 am and 6 pm on any day other than a Sunday (Permit Holders A Exempt) on Duke Street, Lowther Street, Swingpump Lane (in place of the loading bay) and Strand Street (to replace loading bays), Whitehaven;

(d) Extend the “Disc Parking Places, Waiting Limited to 1 hour, return prohibited within 1 hour, between 8 am and 6 pm on a Monday, Tuesday, Wednesday and Friday” on Market Place, Whitehaven.

(e) Remove part of the “Disc Parking Places” Zone, between 7 am and 6 pm on a Monday, Tuesday, Wednesday and Friday, waiting limited to 3 hours, no return within 3 hours” on Market Place, Whitehaven (to make provision for disc-free parking);

(f) Remove the “Loading and Unloading Areas for Goods Vehicles between 8.30 am and 6 pm on any day other than a Sunday” on Duke Street, Whitehaven (to make provision for disc parking), on Lowther Street, Whitehaven (no public loading), and replace the existing loading area on Lowther Street, Whitehaven, with a new loading area on Duke Street, Whitehaven;

(g) Introduce “Loading and Unloading areas for Business Purposes Only between 8.30 am and 6.00 pm on any day other than a Sunday” on Lowther Street (to replace the removed loading areas on Lowther Street), and one on Duke Street, Whitehaven (in place of the existing loading area on Lowther Street);

(h) Remove “Loading and Unloading” areas for Goods Vehicles, waiting limited to 30 minutes, between 8.30 am and 6 pm on any day other than a Sunday” on Strand Street, Whitehaven, and replace with disc parking areas (see 3(c) and short bay under 10 below);

(i) Introduce “Loading and Unloading areas for Goods Vehicles, waiting limited to 30 minutes, between 8.30 am and 6 pm on any day other than a Sunday” on:

i) Lowther Street, Whitehaven – to replace the Goods Vehicles between 7.00 am and 7.00 pm, Monday – Saturday restriction (and to support BP loading bay);

ii) Strand Street, Whitehaven – to replace part of the Goods Vehicles between 8.30 am and 6.00 pm restriction;

(j) Extend the “No Waiting Except for Cycles” restriction on Lowther Street, Whitehaven;

(k) Extend the “No Entry Except for Buses and Cycles” restriction on Lowther Street, Whitehaven (to include vehicles travelling north-eastwards up Duke Street, from making a right turn into Scotch Street);

(l) Introduce “No Stopping on School Entrance Markings” (At times indicated on signs or on site) on James Pit Road, Whitehaven (Whitehaven School);

(m) Extend the “No Loading or Unloading At Any Time” restrictions on parts of:

i) Scotch Street, or

ii) Lowther Street, or

iii) Duke Street, or

iv) Strand Street, Whitehaven;

(n) Extend or replace various “Disc Parking Places” restrictions (as described above) on Strand Street, Whitehaven;

  1. If any person wishes to question the validity of the Order or any provision contained in it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984 or on the grounds that any requirement of that Act or any instrument made under it has not been complied with in relation to the Order, they may do so by within six weeks of 25 March 2025 by applying to the High Court for this purpose.
