Dorset Council (Parts of Footpath 8, St Leonards & St Ives and Part of Footpath 8, West Moors at St Leonards Farm Park) Public Path Diversion Order 2022
On 13 December 2024 Dorset Council confirmed the above-named order made under Section 119 of the Highways Act 1980 as unopposed and the Council has certified that work has been carried out to bring into use the new highway mentioned in article 3 of the order on it being a fit condition for use by the public.
The effect of the order as confirmed is to divert parts of Footpath 8, St Leonards & St Ives and part of Footpath 8, West Moors as shown on the order map as follows:
From the existing paths:
Part of Footpath 8, St Leonards & St Ives:
- The full width of the footpath from its junction with Footpath 7 at SU 09890131, west then north west across the field and crossing into the next field to SU 09760132. Width: 1.2 metres between enclosures and hedges then 10 feet (wide) between hedgerows to footbridge and parish boundary (as recorded in the County of Dorset definitive statement).
- The full width of the footpath from the unaffected part of Footpath 8 at the field boundary at SU 09790136, north west across the field to the track at SU 09620144. Width: 1.2 feet between enclosures between hedges then 10 feet wide after the hedgerows to Footpath 8 at the parish boundary (as recorded in the County of Dorset definitive statement).
- The full width of the footpath from the unaffected part of Footpath 8 at SU 09620146, north west across a field to its junction with Footpath 8, West Moors at the parish boundary at SU 09590147. Width: 1.2 feet between enclosures and hedges then 10 feet wide after the hedgerows (as recorded in the County of Dorset definitive statement).
Part of Footpath 8, West Moors:
The full width of the footpath from the unaffected part of Footpath 8 at SU 09590147, north west across the field to the track at St Leonards Farm Park and across a field to its junction with Footpath 8, St Leonards and St Ives at SU 09590147 at the parish boundary. (No recorded width).
To the new paths:
Part of Footpath 8, St Leonards & St Ives:
- From its junction with Footpath 7 at SU 09890132, generally west (via SU 09870132) along the southern field boundary to the unaffected part of Footpath 8 at SU 09760132. The width of this part of Footpath 8 varies: 2 metres between SU 09890132 – SU 09870132, 1.5 metres between SU 09870132 – SU 09760132.
- From the unaffected part of Footpath 8 at the field boundary at SU 09790136, west along the field edge to a field boundary at track at SU 09620139 and continuing north east and north west along the track to its junction with the proposed new route of Footpath 8 at SU 09690144. The width of this part of Footpath 8 is 2 metres between SU 09790136 – SU 09620139, 1.2 metres at SU 09620139, 2 metres between SU 09620139 – SU 09690144.
Part of Footpath 8, West Moors:
From the unaffected part of Footpath 8 at SU 09360160, north north east (via SU 09360161) to SU 09380163 then east south east along a track, passing to the north of St Leonards Farm Park to SU 09510160 and south along the track to SU 09510158. It continues east south east along the track to SU 09580156, then south and south south east along the track to its junction with the proposed new route of Footpath 8, St Leonards and St Ives at the parish boundary at SU 09590150. The width of this part of Footpath 8 is 2 metres, except for 1.2 metres at SU 09360161 and SU 09380163.
A copy of the order as confirmed and the order map have been placed and may be seen free of charge at Reception, County Hall, Colliton Park, Dorchester during normal office hours. Copies are also available on our website at www.dorsetcouncil.gov.uk/row-orders.
The order comes into force on 20 December 2024 but if any person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 20 March 2025, make an application to the High Court.
