What is happening?

NOTICE OF CONFIRMATION OF PUBLIC PATH ORDER

TOWN AND COUNTRY PLANNING ACT 1990 – SECTION 257 AND PARAGRAPH 7 OF SCHEDULE 14

TEST VALLEY BOROUGH COUNCIL

WEST TYTHERLEY FOOTPATH NO.3 (FOOTPATH ROUTE 246/3/2) PUBLIC PATH DIVERSION ORDER NO 2025

On 17th March 2025, Test Valley Borough Council (‘the Council’) confirmed the above order without modification.

The effect of the order as confirmed is to divert the public footpath running from point A (approximately at Grid Reference E 427536, N 129846) and point B (approximately at Grid Reference E 427577, N 129823) to an alternative footpath being 1.5 metres in width, shown marked on the Plan by bold black dashed lines between the said points A and B, as shown on the order map.

A copy of the confirmed order and order map may be seen free of charge at the Council’s offices at Beech Hurst, Weyhill Road, Andover, SP10 3AJ from 09:00 am to 5:00 pm Monday to Thursday and from 9:00 am to 4:30 pm on Fridays. Copies of the Order and map may be purchased there at the price of £1.00 per set or are available on the Test Valley Borough Council’s website www.testvalley.gov.uk, under planning reference 23/01452/FPS.

This order comes into force on the date on which the Council certifies that the terms of Article 2 of the order have been complied with. However, if any person aggrieved by the order desires to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to the confirmation of the order, they may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks from the date on which this notice is first published, as required by paragraph 7 of Schedule 14 to that Act.
