What is happening?
HIGHWAYS ACT 1980 – SECTION 116
STOPPING UP OF LAND AT SUBWAY, MIDDLEBURG SQUARE, CHERITON ROAD AND SUBWAY, MIDDLEBURG SQUARE, CHERITON GARDENS, FOLKESTONE
I AM GIVING NOTICE THAT The Kent County Council as Highway Authority for the County of Kent propose to make an application to the Magistrates’ sitting at Folkestone Magistrates’ Court on the 7th May 2025 at 10am for an Order under Section 116 of the Highways Act 1980 to extinguish highway rights on the grounds that they are unnecessary on the land at Subway, Middleburg Square, Cheriton Road and Subway, Middleburg Square, Cheriton Gardens, Folkestone as shown edged red on the plan held on deposit.
A copy of the draft order and the plan referred to above are on deposit and can be viewed at the main reception of The Kent County Council at Sessions House, County Hall, Maidstone, Kent, ME14 1XQ. Please note, Sessions House reception will be open for members of the public to view these documents Monday to Friday between the hours of 08:00 and 17:00 and will not be open on bank holidays.
Any person to whom this Notice has been given or who uses the highway specified or who would be aggrieved by the making of the Order may appear before the Magistrates’ Court to raise an objection or make a representation on the application. Any person intending to appear before the Magistrates’ Court at the hearing of the application is requested to inform Saira Tamboo by post to Kent County Council, Sessions House, County Hall, Maidstone, Kent ME14 1XQ, by email saira.tamboo@kent.gov.uk, or by telephone 03000 415890 before 28th April 2025 quoting reference number ST/KEN0015:000421.
