EXPERIMENTAL TRAFFIC ORDER 2025

    1. NOTICE IS HEREBY GIVEN that the London Borough of Merton, on 5 March 2025, made the above-mentioned Orders, under sections 9 and 10 of the Road Traffic Regulation Act 1984 and all other enabling powers.

    1. The general effect of the Orders will be to introduce a point closure in:

      (a) Abbey Road, at the location of the existing width restriction, and prohibit motor vehicles, except emergency vehicles, from entering that length of Abbey Road which lies between the northern kerb-line of Station Road and a point 2 metres north of the said kerb-line;

      (b) Pincott Road, at the location of the existing width restriction, and prohibit vehicles, except emergency vehicles, from entering that length of Pincott Road which lies between a point 1 metre south of the common boundary of Nos. 58 and 60 Pincott Road and a point 1 metre north of the said common boundary.

      NB: Pedal cycles and electrically assisted pedal cycles will not be affected.

    1. The Orders have provided that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Council’s Director of Public Realm or some person authorised in that behalf by him may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic, or for preserving or improving the amenities of the area through which any road affected by the Orders runs, modify or suspend the Orders or any provision thereof.

    1. A copy of the Orders, which will come into operation on 14 March 2025 and can continue in force for up to 18 months, of plans of the relevant areas and of the Council’s statement of reasons for making the Orders can be inspected during normal office hours on Mondays to Fridays inclusive at: Merton Link, Merton Civic Centre, London Road, Morden, SM4 5DX, until the Orders cease to have effect.

  1. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders, may, within 6 weeks of the date on which the Orders were made, make application for the purpose to the High Court.

    1. The Council of the London Borough of Merton will consider in due course whether the provisions of the Orders should be reproduced and continued in force indefinitely by means of Orders made under the Road Traffic Regulation Act 1984. Persons desiring to object to the making of the Orders under the said Act of 1984 for the purpose of such reproduction and continuation in force may, within a period of 6 months beginning with the day on which the experimental Orders came into force, or if an experimental Order is varied by another Order or modified pursuant to section 10(2) of the said Act of 1984, within a period of 6 months beginning with the date on which the variation or modification or the latest variation or modification came into force, send a statement in writing of their objection and the grounds thereof to the Director of Public Realm, the Environment, Civic Pride and Climate Department, Merton Civic Centre, London Road, Morden, SM4 5DX quoting reference: ES/ABBEYPINCOTT.

        1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Merton propose to make the above-mentioned Orders under the powers conferred by 6, 45, 46, 49 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984, as amended and all other enabling powers.

        1. The general effect of the ‘Cycle Hire Parking Places’ Order would be to designate a parking place on the carriageway in certain of the lengths of road specified in the Schedule to this notice for the leaving of electric assisted pedal cycles being used in a public hire scheme operated under an agreement with the Council.

        1. The general effect of the other ‘Parking Places’ Orders would be to remove existing lengths of parking place in the lengths of road specified in the Schedule to this notice to accommodate the introduction of pedal cycle hire parking places.

        1. A copy of the proposed Orders and other documents giving more detailed particulars of the Orders, including plans which indicate the roads or lengths of road to which the Orders relate, can be inspected Monday to Friday during normal office hours at Merton Link, Merton Civic Centre, London Road, Morden. Information about the scheme may be viewed at: https://www.merton.gov.uk/streets-parking-transport/cycling/hire/overview.

      1. Any person desiring to comment on the proposed Orders should send a statement in writing of their representations or objections and the grounds thereof, to the Environment, Civic Pride and Climate Department at the Merton Civic Centre, London Road, Morden, SM4 5DX, or alternatively e-mail trafficandhighways@merton.gov.uk quoting reference ES/CYCLEHIREB4, no later than 28 March 2025.
