What is happening?

NOTICE OF CONFIRMATION OF A MODIFICATION ORDER

SECTION 53 OF THE WILDLIFE AND COUNTRYSIDE ACT 1981

The Definitive Map and Statement of Public Rights of Way for the County of Lancashire

The LANCASHIRE COUNTY COUNCIL
UPGRADE OF FOOTPATH TO BRIDLEWAY ON THREAGILL LANE, WARTON, LANCASTER Definitive Map Modification Order 2024

On the 6th day of December 2024 Lancashire County Council confirmed the above Order.

The effect of the Order as confirmed is to modify the Definitive Map and Statement of Public Rights of Way for the area, by recording a Bridleway from open junction with Borwick Lane between Boon Town Farm and 42 and 42a Borwick Lane in an easterly direction descending gently downhill past the house numbered 42a and farm buildings to continue as a bounded track passing under railway via a tunnel and continuing as a bounded track through to an open junction with the A6 (Scotland Road) directly opposite the continuation of Footpath FP0135008 which circumnavigates Pine Lake Resort.

The length of the route is 0.55km and the width varies between 3.5 metres and 5 metres.

A copy of the Order and the Order Map may also be seen free of charge at the offices of Lancaster City Council, and at my offices from 9.00 and 17.00 on weekdays. Copies of the order and map may be bought there at the price of £1.00. A free digital copy of the Order may be requested by emailing simon.moore@lancashire.gov.uk or by telephoning Simon Moore on 01772 531280 between 9.00 and 17.00, Monday to Friday.

The Order took effect on the 06 December 2024 but if a person aggrieved by the Order desires to question the validity on the grounds that it is not within the powers of Section 53 of the Wildlife and Countryside Act 1981, or that any of the requirements of Schedule 15 to the Act have not been complied with in relation to the Order, he may, under Paragraph 12 of Schedule 15 to the Act, within 42 days from the date of publication of this Notice, make an application for the purpose to the High Court.
