What is happening?
NOTICE OF CONFIRMATION OF A RAIL CROSSING DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER

PUBLIC FOOTPATH OVER RAILWAY BETWEEN HOLTS LANE AND FOOTPATH POULTON-LE-FYLDE 4, RAIL CROSSING DIVERSION ORDER 2019
On 20 July 2023, the Secretary of State for the Environment confirmed the above Order made under section 119A of the Highways Act 1980.
The effect of the Order, as confirmed is to divert the footpath running west from grid reference SD 3583 3884 for 15 metres to Holts lane at SD 3582 3884, to a new line starting at the same point then running 90 metres over a stepped footbridge to Holts Lane at SD 3581 3884, as shown on the Order Map.
A copy of the Order as confirmed, and the Order Map have been placed and may be seen free of charge at my offices from 9am to 5pm on weekdays. Copies of the Order and Map may be bought there at the price of £1.00. Alternatively, digital copies of the Order and Map may be requested by emailing Simon Moore at simon.moore@lancashire.gov.uk
Any person who wishes to claim compensation under Section 28 as applied by Section 121(2) of the 1980 Act for depreciation or damage for disturbance arising as a result of the coming into force of the Order must make a claim in writing addressed to the Director of Law and Governance, Lancashire County Council, PO Box 100, County Hall, Preston, PR1 0LD (REF: LSG4/SM18/894.9805/211-717), and serve it by delivering it at, or sending it by prepaid post to, that address not later than the 23 July 2025. A copy of the section is attached.
The creation of the new footpath comes into force on 23 January 2025. The extinguishment of the public right of way will not come into force until the highway authority for the new footpath certify that the work to bring it into a fit condition for public use has been carried out. If a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that a requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within six weeks from the 23 January 2025 make an application to the High Court.
